| 7 | 7 | | relating to the applicability of certain provisions concerning the |
|---|
| 8 | 8 | | transfer of exotic species to certain transfers of water that |
|---|
| 9 | 9 | | supply populous areas. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 66.007, Parks and Wildlife Code, is |
|---|
| 12 | 12 | | amended by adding Subsection (m) to read as follows: |
|---|
| 13 | 13 | | (m) A water transfer described by this subsection is not a |
|---|
| 14 | 14 | | violation of this section. The department may not require a permit |
|---|
| 15 | 15 | | under this section for a water transfer described by this |
|---|
| 16 | 16 | | subsection. This subsection applies to a water transfer by a |
|---|
| 17 | 17 | | district or authority created under Section 59, Article XVI, Texas |
|---|
| 18 | 18 | | Constitution, that: |
|---|
| 19 | 19 | | (1) is initially conveyed by a water intake structure |
|---|
| 20 | 20 | | that is: |
|---|
| 21 | 21 | | (A) shared by at least two districts or |
|---|
| 22 | 22 | | authorities; and |
|---|
| 23 | 23 | | (B) located on a reservoir situated on the |
|---|
| 24 | 24 | | boundary of this state and another state; |
|---|
| 25 | 25 | | (2) uses a closed conveyance system approved by the |
|---|
| 26 | 26 | | United States Army Corps of Engineers in accordance with an |
|---|
| 27 | 27 | | invasive species management plan approved by the United States Army |
|---|
| 28 | 28 | | Corps of Engineers; and |
|---|
| 29 | 29 | | (3) contributes to a water supply that serves at least |
|---|
| 30 | 30 | | 1.5 million people, all of whom reside in an area that: |
|---|
| 31 | 31 | | (A) borders another state; |
|---|
| 32 | 32 | | (B) contains at least 10 contiguous counties; |
|---|
| 33 | 33 | | (C) contains at least one county with a |
|---|
| 34 | 34 | | population of more than one million; and |
|---|
| 35 | 35 | | (D) is adjacent to a county with a population of |
|---|
| 36 | 36 | | more than one million. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2013. |
