88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the authority of a county to deposit fees collected by a
1111 county bail bond board in a separate county fund.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 1704.101, Occupations Code, is amended
1414 to read as follows:
1515 Sec. 1704.101. ADMINISTRATIVE AUTHORITY. A board shall:
1616 (1) exercise powers incidental or necessary to the
1717 administration of this chapter;
1818 (2) deposit fees collected under this chapter in the
1919 general fund of the county or in a separate county fund established
2020 for this purpose;
2121 (3) supervise and regulate each phase of the bonding
2222 business in the county;
2323 (4) adopt and post rules necessary to implement this
2424 chapter;
2525 (5) conduct hearings and investigations and make
2626 determinations relating to the issuance, denial, or renewal of
2727 licenses;
2828 (6) issue licenses to qualified applicants;
2929 (7) deny licenses to unqualified applicants;
3030 (8) employ persons necessary to assist in board
3131 functions; and
3232 (9) conduct board business, including maintaining
3333 records and minutes.
3434 SECTION 2. Subsection (a), Section 1704.103, Occupations
3535 Code, is amended to read as follows:
3636 (a) Fees deposited in the general fund of a county or in a
3737 separate county fund under Section 1704.101(2) may be used only to
3838 administer and enforce this chapter, including reimbursement for:
3939 (1) reasonable expenses incurred by the board in
4040 enforcing this chapter; and
4141 (2) actual expenses incurred by a board member in
4242 serving on the board.
4343 SECTION 3. A county that establishes a separate county fund
4444 for the purpose of depositing fees collected under Chapter 1704,
4545 Occupations Code, as provided by Section 1704.101, Occupations
4646 Code, as amended by this Act, may transfer fees previously
4747 collected under Chapter 1704, Occupations Code, and deposited in
4848 the county's general fund to the separate fund.
4949 SECTION 4. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2013.
