| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (b), Section 68.051, Water Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) This chapter applies to the following types of |

| 21 | 21 | | (6) a facility subject to 40 C.F.R. Part 112; |
|---|
| 22 | 22 | | (7) a general shipyard facility as defined by 46 |
|---|
| 23 | 23 | | C.F.R. Section 298.2; |
|---|
| 24 | 24 | | (8) a facility included in one or more of the following |

| 25 | 25 | | categories and codes of the 2007 North American Industry |
|---|

| 53 | 53 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 57 | 57 | | Act takes effect September 1, 2013. |
