77 relating to the facilities to which Chapter 68, Water Code,
88 applies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 68.051, Water Code, is
1111 amended to read as follows:
1212 (b) This chapter applies to the following types of
1313 facilities in the district:
1414 (1) a chemical manufacturers' association facility;
1515 (2) a mutual aid organization facility;
1616 (3) a facility as defined in 46 U.S.C. Section 70101;
1717 (4) a facility described by 33 C.F.R. Section
1818 105.105(a);
1919 (5) a facility subject to an area maritime
2020 transportation security plan under 46 U.S.C. Section 70103(b);
2121 (6) a facility subject to 40 C.F.R. Part 112;
2222 (7) a general shipyard facility as defined by 46
2323 C.F.R. Section 298.2;
2424 (8) a facility included in one or more of the following
2525 categories and codes of the 2007 North American Industry
2626 Classification System:
2727 (A) crude petroleum and natural gas extraction,
2828 211111;
2929 (B) petroleum refineries, 324110;
3030 (C) petrochemical [petroleum] manufacturing,
3131 3251 [325110];
3232 (D) petroleum lubricating oil and grease
3333 manufacturing, 324191;
3434 (E) all other petroleum and coal products
3535 manufacturing, 324199;
3636 (F) all other chemical [and other]
3737 manufacturing, 325998 [311111-339999];
3838 (G) petroleum bulk stations and terminals,
3939 424710;
4040 (H) plastics, chemical, and petroleum
4141 wholesalers, 424610, 424690, and 424720;
4242 (I) transportation, including rail, water, and
4343 road transportation and pipelines, 482111-482112, 483111-483114,
4444 484110-484230, 486110-486990, 488210, 488390, and 488490;
4545 (J) port and harbor operations, 488310;
4646 (K) marine cargo handling, 488320;
4747 (L) warehousing and storage, including general,
4848 refrigerated, farm and other, 493110, 493120, 493130, and 493190;
4949 and
5050 (M) deep sea and coastal freight and passenger
5151 transportation, 483111-483114; and
5252 (9) a facility described by Subsection (c).
5353 SECTION 2. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2013.
