77 relating to the extension of an emergency order for protective
88 services for certain persons who are elderly or have disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (e-2), Section 48.208, Human
1111 Resources Code, is amended to read as follows:
1212 (e-2) The court, after notice and a hearing, may extend an
1313 emergency order issued under this section, other than an emergency
1414 order that terminated as provided under Subsection (e-1), for a
1515 period of not more than 30 days after the date the original
1616 emergency order for protective services would have expired under
1717 Subsection (e) [was rendered]. The court, after notice and a
1818 hearing and for good cause shown, may grant a second extension of an
1919 emergency order of not more than an additional 30 days. The court
2020 may not grant more than two extensions of the original emergency
2121 order. An extension order that ends on a Saturday, Sunday, or legal
2222 holiday is automatically extended to 4 p.m. on the first succeeding
2323 business day. The court may modify or terminate the emergency order
2424 on petition of the department, the incapacitated person, or any
2525 person interested in the person's welfare.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2013.
