| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 1.33, Chapter 626 (S.B. 1477), Acts of | |
| 11 | 11 | the 73rd Legislature, Regular Session, 1993, is amended by amending | |
| 12 | 12 | Subsection (c) and adding Subsection (d) to read as follows: | |
| 13 | 13 | (c) A well [within or] serving a subdivision requiring | |
| 14 | 14 | platting does not qualify for an exempt use. | |
| 15 | 15 | (d) A well drilled on or before June 1, 2013, for any purpose | |
| 16 | 16 | authorized under this article is exempt from the requirement to | |
| 17 | 17 | obtain a withdrawal permit provided that the well: | |
| 18 | 18 | (1) is not capable of producing more than 1,250 | |
| 19 | 19 | gallons of water a day; or | |
| 20 | 20 | (2) is metered and does not produce more than 1.4 | |
| 21 | 21 | acre-feet of water in a calendar year. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2013. |
