| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Subsection (e-1), Section 12.052, Water Code, is | |
| 14 | 14 | amended to read as follows: | |
| 15 | 15 | (e-1) The commission shall exempt an owner of a dam located | |
| 16 | 16 | on private property from meeting requirements related to dam safety | |
| 17 | 17 | if the dam: | |
| 18 | 18 | (1) at maximum capacity impounds less than 500 | |
| 19 | 19 | acre-feet; | |
| 20 | 20 | (2) has a hazard classification of low or significant; | |
| 21 | 21 | (3) is located in a county with a population of less | |
| 22 | 22 | than 350,000 [215,000]; and | |
| 23 | 23 | (4) is not located inside the corporate limits of a | |
| 24 | 24 | municipality. | |
| 25 | 25 | SECTION 2. Subsection (e-3), Section 12.052, Water Code, is | |
| 26 | 26 | repealed. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2013. | |
