9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 82.003, Family Code, is amended to read | |
11 | 11 | as follows: | |
12 | 12 | Sec. 82.003. VENUE. An application may be filed in: | |
13 | 13 | (1) the county in which the applicant resides; [or] | |
14 | 14 | (2) the county in which the respondent resides; or | |
15 | 15 | (3) any county in which the family violence is alleged | |
16 | 16 | to have occurred. | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to an application for a protective order that is filed on or after | |
19 | 19 | the effective date of this Act. An application for a protective | |
20 | 20 | order filed before the effective date of this Act is governed by the | |
21 | 21 | law in effect on the date the application is filed, and the former | |
22 | 22 | law is continued in effect for that purpose. | |
23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2013. |
