77 relating to proper venue for filing an application for a protective
88 order against family violence.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 82.003, Family Code, is amended to read
1111 as follows:
1212 Sec. 82.003. VENUE. An application may be filed in:
1313 (1) the county in which the applicant resides; [or]
1414 (2) the county in which the respondent resides; or
1515 (3) any county in which the family violence is alleged
1616 to have occurred.
1717 SECTION 2. The change in law made by this Act applies only
1818 to an application for a protective order that is filed on or after
1919 the effective date of this Act. An application for a protective
2020 order filed before the effective date of this Act is governed by the
2121 law in effect on the date the application is filed, and the former
2222 law is continued in effect for that purpose.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2013.
