77 relating to representation by prosecuting attorneys in proceedings
88 for protective orders against family violence and in certain other

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 81.0075, Family Code, is amended to read
1212 as follows:
1313 Sec. 81.0075. REPRESENTATION BY PROSECUTING ATTORNEY IN
1414 CERTAIN OTHER [SUBSEQUENT] ACTIONS. Subject to the Texas
1515 Disciplinary Rules of Professional Conduct, a [A] prosecuting
1616 attorney [who represents a party in a proceeding under this
1717 subtitle] is not precluded from representing a party in a
1818 proceeding under this subtitle and the Department of Family and
1919 Protective Services in another [a subsequent] action involving the
2020 party, regardless of whether the proceeding under this subtitle
2121 occurs before, concurrently with, or after the other action
2222 involving the party.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2013.
