LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION April 29, 2013 TO: Honorable Dan Patrick, Chair, Senate Committee on Education FROM: Ursula Parks, Director, Legislative Budget Board IN RE:SB1304 by Davis (Relating to a requirement for school districts to report disciplinary actions to the commissioner of education.), As Introduced No significant fiscal implication to the State is anticipated. The bill would require school districts to submit to the Texas Education Agency (TEA) a report that contained each instance in which a student was subject to certain disciplinary actions. The bill would also require that for each disciplinary action, the report would include the student's age, sex, race or ethnicity, and special education eligibility and would comply with the Family Educational Rights and Privacy Act (FERPA). The bill would add one additional data element, corporal punishment, to the current disciplinary action reporting requirements. TEA indicates that the collection of any new disciplinary data elements could be absorbed within existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated. School districts costs could vary depending on the extent to which local student information software requires modification and how that software is managed locally, through vendor contracts or with internal resources.
