| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 37.0011, Education Code, is amended by |
|---|
| 15 | 15 | | adding Subsection (e) to read as follows: |
|---|
| 16 | 16 | | (e) A school district in which corporal punishment is |
|---|
| 17 | 17 | | permitted as a method of student discipline shall report in each |
|---|
| 18 | 18 | | district Public Education Information Management System (PEIMS) |
|---|
| 19 | 19 | | submission each instance during the period covered by the |
|---|
| 20 | 20 | | submission in which a district student is subject to the use of |
|---|
| 21 | 21 | | corporal punishment. The report: |
|---|
| 22 | 22 | | (1) must include for each instance information |
|---|
| 23 | 23 | | identifying: |
|---|
| 24 | 24 | | (A) the age of the student; |
|---|
| 25 | 25 | | (B) the sex of the student; |
|---|
| 26 | 26 | | (C) the race or ethnicity of the student; and |
|---|
| 27 | 27 | | (D) whether the student is eligible for special |
|---|
| 28 | 28 | | education services under Section 29.003; |
|---|
| 29 | 29 | | (2) must comply with the Family Educational Rights and |
|---|
| 30 | 30 | | Privacy Act of 1974 (20 U.S.C. Section 1232g); and |
|---|
| 31 | 31 | | (3) may not include personally identifiable student |
|---|
| 32 | 32 | | information. |
|---|
| 33 | 33 | | SECTION 2. Subchapter C, Chapter 37, Education Code, is |
|---|
| 34 | 34 | | amended by adding Section 37.0811 to read as follows: |
|---|
| 35 | 35 | | Sec. 37.0811. REPORT REGARDING CITATIONS ON CAMPUS. |
|---|
| 36 | 36 | | (a) In this section, "citation" means a ticket issued for a Class C |
|---|
| 37 | 37 | | misdemeanor. |
|---|
| 38 | 38 | | (b) The commissioner shall adopt rules requiring a school |
|---|
| 39 | 39 | | district to report to the agency information relating to the |
|---|
| 40 | 40 | | issuance of citations by a peace officer to students on a district |
|---|
| 41 | 41 | | campus. The agency shall collect the reports required under this |
|---|
| 42 | 42 | | section, compile the data, and make the data available to the |
|---|
| 43 | 43 | | public. |
|---|
| 44 | 44 | | SECTION 3. This Act applies beginning with the 2013-2014 |
|---|
| 45 | 45 | | school year. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2013. |
