99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to school district reports concerning corporal punishment
1212 and the issuance of citations by a peace officer.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 37.0011, Education Code, is amended by
1515 adding Subsection (e) to read as follows:
1616 (e) A school district in which corporal punishment is
1717 permitted as a method of student discipline shall report in each
1818 district Public Education Information Management System (PEIMS)
1919 submission each instance during the period covered by the
2020 submission in which a district student is subject to the use of
2121 corporal punishment. The report:
2222 (1) must include for each instance information
2323 identifying:
2424 (A) the age of the student;
2525 (B) the sex of the student;
2626 (C) the race or ethnicity of the student; and
2727 (D) whether the student is eligible for special
2828 education services under Section 29.003;
2929 (2) must comply with the Family Educational Rights and
3030 Privacy Act of 1974 (20 U.S.C. Section 1232g); and
3131 (3) may not include personally identifiable student
3232 information.
3333 SECTION 2. Subchapter C, Chapter 37, Education Code, is
3434 amended by adding Section 37.0811 to read as follows:
3535 Sec. 37.0811. REPORT REGARDING CITATIONS ON CAMPUS.
3636 (a) In this section, "citation" means a ticket issued for a Class C
3737 misdemeanor.
3838 (b) The commissioner shall adopt rules requiring a school
3939 district to report to the agency information relating to the
4040 issuance of citations by a peace officer to students on a district
4141 campus. The agency shall collect the reports required under this
4242 section, compile the data, and make the data available to the
4343 public.
4444 SECTION 3. This Act applies beginning with the 2013-2014
4545 school year.
4646 SECTION 4. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2013.
