10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter B, Chapter 39, Education Code, is | |
12 | 12 | amended by adding Section 39.038 to read as follows: | |
13 | 13 | Sec. 39.038. AUDITING AND MONITORING PERFORMANCE UNDER | |
14 | 14 | CONTRACTS FOR ASSESSMENT INSTRUMENTS. (a) The agency by rule | |
15 | 15 | shall develop a comprehensive methodology for auditing and | |
16 | 16 | monitoring performance under contracts for services to develop or | |
17 | 17 | administer assessment instruments required by Section 39.023 to | |
18 | 18 | verify compliance with contractual obligations. | |
19 | 19 | (b) The agency shall ensure that all new and renewed | |
20 | 20 | contracts described by Subsection (a) include a provision that the | |
21 | 21 | agency or a designee of the agency may conduct periodic contract | |
22 | 22 | compliance reviews, without advance notice, to monitor vendor | |
23 | 23 | performance. | |
24 | 24 | (c) The agency shall adopt rules to administer this section. | |
25 | 25 | SECTION 2. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2013. |
