66 AN ACT
77 relating to inclusion of mental health concerns in existing state
88 and local coordinated school health efforts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.004, Education Code, is amended by
1111 amending Subsections (c) and (d) and adding Subsection (l-1) to
1212 read as follows:
1313 (c) The local school health advisory council's duties
1414 include recommending:
1515 (1) the number of hours of instruction to be provided
1616 in health education;
1717 (2) policies, procedures, strategies, and curriculum
1818 appropriate for specific grade levels designed to prevent obesity,
1919 cardiovascular disease, [and] Type 2 diabetes, and mental health
2020 concerns through coordination of:
2121 (A) health education;
2222 (B) physical education and physical activity;
2323 (C) nutrition services;
2424 (D) parental involvement; [and]
2525 (E) instruction to prevent the use of tobacco;
2626 (F) school health services;
2727 (G) counseling and guidance services;
2828 (H) a safe and healthy school environment; and
2929 (I) school employee wellness; and
3030 (3) appropriate grade levels and methods of
3131 instruction for human sexuality instruction[; and
3232 [(4) strategies for integrating the curriculum
3333 components specified by Subdivision (2) with the following elements
3434 in a coordinated school health program for the district:
3535 [(A) school health services;
3636 [(B) counseling and guidance services;
3737 [(C) a safe and healthy school environment; and
3838 [(D) school employee wellness].
3939 (d) The board of trustees shall appoint at least five
4040 members to the local school health advisory council. A majority of
4141 the members must be persons who are parents of students enrolled in
4242 the district and who are not employed by the district. One of those
4343 members shall serve as chair or co-chair of the council. The board
4444 of trustees also may appoint one or more persons from each of the
4545 following groups or a representative from a group other than a group
4646 specified under this subsection:
4747 (1) public school teachers;
4848 (2) public school administrators;
4949 (3) district students;
5050 (4) health care professionals;
5151 (5) the business community;
5252 (6) law enforcement;
5353 (7) senior citizens;
5454 (8) the clergy;
5555 (9) nonprofit health organizations; [and]
5656 (10) local domestic violence programs;
5757 (11) local community mental health providers; and
5858 (12) local substance abuse services providers.
5959 (l-1) The local school health advisory council shall:
6060 (1) review the adopted health education curriculum for
6161 accuracy and content related to mental health and consider the
6262 inclusion of the following topics:
6363 (A) recognition of signs and symptoms related to
6464 mental illness;
6565 (B) mental health stigmas;
6666 (C) substance abuse; and
6767 (D) stress management;
6868 (2) make recommendations regarding professional
6969 development designed to promote the ability of school district
7070 staff to build positive relationships with students, increase
7171 school connectedness, and improve recognition and understanding of
7272 mental health issues; and
7373 (3) make policy recommendations to the school district
7474 concerning the integration of social and emotional learning into
7575 the academic curriculum.
7676 SECTION 2. Subsection (a), Section 38.013, Education Code,
7777 is amended to read as follows:
7878 (a) The agency shall make available to each school district
7979 one or more coordinated health programs designed to prevent
8080 obesity, cardiovascular disease, [and] Type 2 diabetes, and mental
8181 health concerns in elementary school, middle school, and junior
8282 high school students. Each program must provide for coordinating:
8383 (1) health education;
8484 (2) physical education and physical activity;
8585 (3) nutrition services; [and]
8686 (4) parental involvement; and
8787 (5) physical and mental health policies, services, and
8888 supports.
8989 SECTION 3. This Act takes effect immediately if it receives
9090 a vote of two-thirds of all the members elected to each house, as
9191 provided by Section 39, Article III, Texas Constitution. If this
9292 Act does not receive the vote necessary for immediate effect, this
9393 Act takes effect September 1, 2013.
