83R10156 KLA-D By: Davis S.B. No. 1370 A BILL TO BE ENTITLED AN ACT relating to the deposit of money received from the federal government. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 404.094, Government Code, is amended by amending Subsection (b) and adding Subsections (e), (f), and (g) to read as follows: (b) Money that is required by this subchapter or by another law to be deposited in the treasury shall be deposited to the credit of the general revenue fund unless the money is required by Subsection (e) or otherwise expressly required to be deposited to another fund, trust fund, or special account not in the general revenue fund. This subsection does not affect the authority of the comptroller to establish and use accounts necessary to manage and account for state revenues and expenditures. (e) Notwithstanding any other law and except as otherwise required by federal law or this state's constitution, the comptroller shall deposit money collected or received from the federal government to the credit of: (1) a fund in the state treasury outside the general revenue fund that is specified by general law; or (2) if general law does not specify a fund described by Subdivision (1), another fund in the state treasury outside the general revenue fund, or an account in another of those funds, established by the comptroller for purposes of this subsection. (f) The comptroller may establish funds in the state treasury outside the general revenue fund and accounts in those funds as necessary for purposes of Subsection (e). (g) Subsection (e) does not affect a dedication of money to one or more purposes or entities that is specified by general law or otherwise affect authority to spend money as provided by general law. SECTION 2. Section 404.094, Government Code, as amended by this Act, applies only to money received from the federal government on or after September 1, 2015. Money received from the federal government before that date is governed by the law in effect immediately before the effective date of this Act, and that law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2013.
