1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to requiring municipalities to reimburse the Texas
1313 Department of Transportation for compensation paid for certain
1414 signs required to be relocated due to road construction.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter A, Chapter 216, Local Government
1717 Code, is amended by adding Section 216.016 to read as follows:
1818 Sec. 216.016. COSTS OF REMOVAL DUE TO ROAD CONSTRUCTION.
1919 (a) If a sign located in a municipality is required to be removed
2020 because of the widening, construction, or reconstruction of a road
2121 by the Texas Department of Transportation and if relocation of the
2222 sign in the municipality would be allowed under department rules
2323 but is restricted or prohibited by charter, ordinance, or a
2424 decision of the municipality, the municipality shall reimburse the
2525 department for any just compensation paid to the owner or lessee of
2626 the sign in a condemnation proceeding.
2727 (b) For purposes of this section, a sign located in the
2828 extraterritorial jurisdiction of a municipality is considered
2929 located in the municipality.
3030 SECTION 2. The change in law made by this Act applies only
3131 to the removal of a sign that occurs on or after the effective date
3232 of this Act.
3333 SECTION 3. This Act takes effect September 1, 2013.
