8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subsections (a) and (c), Section 421.002, |
---|
10 | 10 | | Government Code, are amended to read as follows: |
---|
11 | 11 | | (a) The governor shall direct homeland security in this |
---|
12 | 12 | | state and shall develop a statewide homeland security strategy that |
---|
13 | 13 | | improves the state's ability to: |
---|
14 | 14 | | (1) protect against [detect and deter threats to] |
---|
15 | 15 | | homeland security threats and hazards; |
---|
16 | 16 | | (2) respond to homeland security emergencies; [and] |
---|
17 | 17 | | (3) recover from homeland security emergencies; |
---|
18 | 18 | | (4) mitigate the loss of life and property by |
---|
19 | 19 | | lessening the impact of future disasters; and |
---|
20 | 20 | | (5) prevent significant criminal and terrorist |
---|
21 | 21 | | attacks. |
---|
22 | 22 | | (c) The governor's homeland security strategy must |
---|
23 | 23 | | complement and operate in coordination with [the] federal strategic |
---|
24 | 24 | | guidance on homeland security [strategy]. |
---|
25 | 25 | | SECTION 2. Subsection (a), Section 421.021, Government |
---|
26 | 26 | | Code, is amended to read as follows: |
---|
27 | 27 | | (a) The Homeland Security Council is composed of the |
---|
28 | 28 | | governor or the governor's designee, the speaker of the house of |
---|
29 | 29 | | representatives or the speaker's designee, the lieutenant governor |
---|
30 | 30 | | or the lieutenant governor's designee, and one representative of |
---|
31 | 31 | | each of the following entities, appointed by the single statewide |
---|
32 | 32 | | elected or appointed governing officer, administrative head, or |
---|
33 | 33 | | chair, as appropriate, of the entity: |
---|
34 | 34 | | (1) Department of Agriculture; |
---|
35 | 35 | | (2) office of the attorney general; |
---|
36 | 36 | | (3) General Land Office; |
---|
37 | 37 | | (4) Public Utility Commission of Texas; |
---|
38 | 38 | | (5) Department of State Health Services; |
---|
39 | 39 | | (6) Department of Information Resources; |
---|
40 | 40 | | (7) Department of Public Safety of the State of Texas; |
---|
41 | 41 | | (8) Texas Division of Emergency Management; |
---|
42 | 42 | | (9) adjutant general's department; |

67 | 67 | | SECTION 3. This Act takes effect immediately if it receives |
---|
68 | 68 | | a vote of two-thirds of all the members elected to each house, as |
---|
69 | 69 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
70 | 70 | | Act does not receive the vote necessary for immediate effect, this |
---|
71 | 71 | | Act takes effect September 1, 2013. |
