| 10 | 10 | | Commission. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 531.066 to read as follows: |
|---|
| 14 | 14 | | Sec. 531.066. PARTICIPATION OF DIAGNOSTIC LABORATORY |
|---|
| 15 | 15 | | SERVICE PROVIDERS IN CERTAIN PROGRAMS. Notwithstanding any other |
|---|
| 16 | 16 | | law, a diagnostic laboratory may participate as an in-state |
|---|
| 17 | 17 | | provider under any program administered by a health and human |
|---|
| 18 | 18 | | services agency or the commission that involves diagnostic |
|---|
| 19 | 19 | | laboratory services, regardless of the location where any specific |
|---|
| 20 | 20 | | service is performed or where the laboratory's facilities are |
|---|
| 21 | 21 | | located if: |
|---|
| 22 | 22 | | (1) the laboratory or an entity that is a parent, |
|---|
| 23 | 23 | | subsidiary, or other affiliate of the laboratory maintains |
|---|
| 24 | 24 | | diagnostic laboratory operations in this state; |
|---|
| 25 | 25 | | (2) the laboratory and each entity that is a parent, |
|---|
| 26 | 26 | | subsidiary, or other affiliate of the laboratory, individually or |
|---|
| 27 | 27 | | collectively, employ at least 1,000 persons at places of employment |
|---|
| 28 | 28 | | located in this state; and |
|---|
| 29 | 29 | | (3) the laboratory is otherwise qualified to provide |
|---|
| 30 | 30 | | the services under the program and is not prohibited from |
|---|
| 31 | 31 | | participating as a provider under any benefits programs |
|---|
| 32 | 32 | | administered by a health and human services agency or the |
|---|
| 33 | 33 | | commission based on conduct that constitutes fraud, waste, or |
|---|
| 34 | 34 | | abuse. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2013. |
