99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to public school performance ratings that reflect
1212 acceptable and unacceptable performance.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 39.054, Education Code, is amended by
1515 amending Subsection (a) and adding Subsection (a-1) to read as
1616 follows:
1717 (a) The commissioner shall adopt rules to evaluate school
1818 district and campus performance and, not later than August 8 of each
1919 year, assign each district and campus a performance rating of A, B,
2020 C, D, or F. In adopting rules under this subsection, the
2121 commissioner shall determine the criteria for each designated
2222 letter performance rating and designate whether the letter
2323 performance rating [that] reflects acceptable performance or
2424 unacceptable performance. If a district or campus earned
2525 [received] a performance rating of D or F [unacceptable
2626 performance] for the preceding school year, the commissioner shall
2727 notify the district of a subsequent such designation on or before
2828 June 15.
2929 (a-1) In adopting rules for a district or campus performance
3030 rating under Subsection (a), the commissioner shall assign a letter
3131 performance rating:
3232 (1) in a manner that gives greater weight to the
3333 performance of a district or campus regarding the required
3434 improvement rate determined by the commissioner under Section
3535 39.053(e) for the student achievement indicators adopted under
3636 Section 39.053(c); and
3737 (2) based on:
3838 (A) the measure of annual improvement in student
3939 achievement determined by the commissioner under Section 39.034;
4040 and
4141 (B) other factors, as determined by the
4242 commissioner, for determining sufficient student attainment of
4343 postsecondary readiness.
4444 SECTION 2. This Act applies beginning with the 2013-2014
4545 school year.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2013.
