10	10	AN ACT
11	11	relating to public school performance ratings that reflect
12	12	acceptable and unacceptable performance.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 39.054, Education Code, is amended by
15	15	amending Subsection (a) and adding Subsection (a-1) to read as
16	16	follows:
17	17	(a) The commissioner shall adopt rules to evaluate school
18	18	district and campus performance and, not later than August 8 of each
19	19	year, assign each district and campus a performance rating of A, B,
20	20	C, D, or F. In adopting rules under this subsection, the
21	21	commissioner shall determine the criteria for each designated
22	22	letter performance rating and designate whether the letter
23	23	performance rating [that] reflects acceptable performance or
24	24	unacceptable performance. If a district or campus earned
25	25	[received] a performance rating of D or F [unacceptable
26	26	performance] for the preceding school year, the commissioner shall
27	27	notify the district of a subsequent such designation on or before
28	28	June 15.
29	29	(a-1) In adopting rules for a district or campus performance
30	30	rating under Subsection (a), the commissioner shall assign a letter
31	31	performance rating:
32	32	(1) in a manner that gives greater weight to the
33	33	performance of a district or campus regarding the required
34	34	improvement rate determined by the commissioner under Section
35	35	39.053(e) for the student achievement indicators adopted under
36	36	Section 39.053(c); and
37	37	(2) based on:
38	38	(A) the measure of annual improvement in student
39	39	achievement determined by the commissioner under Section 39.034;
40	40	and
41	41	(B) other factors, as determined by the
42	42	commissioner, for determining sufficient student attainment of
43	43	postsecondary readiness.
44	44	SECTION 2. This Act applies beginning with the 2013-2014
45	45	school year.
46	46	SECTION 3. This Act takes effect immediately if it receives
47	47	a vote of two-thirds of all the members elected to each house, as
48	48	provided by Section 39, Article III, Texas Constitution. If this
49	49	Act does not receive the vote necessary for immediate effect, this
50	50	Act takes effect September 1, 2013.
