77 relating to the punishment for violating certain rules or permit
88 terms under a permit to trap, transport, and transplant certain
99 animals.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.062, Parks and Wildlife Code, is
1212 amended to read as follows:
1313 Sec. 43.062. PENALTY. (a) Except as provided by
1414 Subsection (b), a [A] person who violates any provision of this
1515 subchapter or the terms of a permit issued under this subchapter
1616 commits an offense that is a Class B Parks and Wildlife Code
1717 misdemeanor.
1818 (b) A person commits an offense that is a Class C Parks and
1919 Wildlife Code misdemeanor if the person violates:
2020 (1) a rule relating to a reporting requirement for a
2121 permit issued under this subchapter; or
2222 (2) a term of a permit issued under this subchapter
2323 that relates to a reporting requirement.
2424 SECTION 2. The changes in law made by this Act apply only to
2525 an offense committed on or after the effective date of this Act. An
2626 offense committed before the effective date of this Act is covered
2727 by the law in effect when the offense was committed, and the former
2828 law is continued in effect for that purpose. For purposes of this
2929 section, an offense was committed before the effective date of this
3030 Act if any element of the offense was committed before that date.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2013.
