| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 43.062, Parks and Wildlife Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 43.062. PENALTY. (a) Except as provided by |
|---|
| 14 | 14 | | Subsection (b), a [A] person who violates any provision of this |
|---|
| 15 | 15 | | subchapter or the terms of a permit issued under this subchapter |
|---|
| 16 | 16 | | commits an offense that is a Class B Parks and Wildlife Code |
|---|
| 17 | 17 | | misdemeanor. |
|---|
| 18 | 18 | | (b) A person commits an offense that is a Class C Parks and |
|---|
| 19 | 19 | | Wildlife Code misdemeanor if the person violates: |
|---|
| 20 | 20 | | (1) a rule relating to a reporting requirement for a |
|---|
| 21 | 21 | | permit issued under this subchapter; or |
|---|
| 22 | 22 | | (2) a term of a permit issued under this subchapter |
|---|
| 23 | 23 | | that relates to a reporting requirement. |
|---|
| 24 | 24 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 25 | 25 | | an offense committed on or after the effective date of this Act. An |
|---|
| 26 | 26 | | offense committed before the effective date of this Act is covered |
|---|
| 27 | 27 | | by the law in effect when the offense was committed, and the former |
|---|
| 28 | 28 | | law is continued in effect for that purpose. For purposes of this |
|---|
| 29 | 29 | | section, an offense was committed before the effective date of this |
|---|
| 30 | 30 | | Act if any element of the offense was committed before that date. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2013. |
