66 AN ACT
77 relating to the chief executive officer of the Hopkins County
88 Hospital District and to the delegation of certain authority by the
99 district's board of directors to the chief executive officer.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1043.059, Special District Local Laws
1212 Code, is amended by amending Subsection (a) and adding Subsection
1313 (a-1) to read as follows:
1414 (a) The board may employ an [a general manager,] attorney,
1515 bookkeeper, and architect.
1616 (a-1) The board may delegate to the chief executive officer
1717 the authority to hire, terminate, and make all other personnel
1818 decisions relating to district employees.
1919 SECTION 2. Subchapter B, Chapter 1043, Special District
2020 Local Laws Code, is amended by adding Section 1043.062 to read as
2121 follows:
2222 Sec. 1043.062. CHIEF EXECUTIVE OFFICER. (a) The board
2323 shall appoint a qualified person as the chief executive officer of
2424 the district.
2525 (b) The chief executive officer serves at the will of the
2626 board and is entitled to the compensation determined by the board.
2727 (c) Subject to the limitations prescribed by the board, the
2828 chief executive officer shall:
2929 (1) supervise the work and activities of the district;
3030 and
3131 (2) direct the affairs of the district.
3232 (d) If the board delegates to the chief executive officer
3333 the authority to hire, terminate, and make all other personnel
3434 decisions relating to district employees, the chief executive
3535 officer has exclusive authority over personnel matters and the
3636 board may not participate in or make any decisions regarding the
3737 employment of district employees other than the chief executive
3838 officer.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2013.
