77 relating to increased oversight by the Department of State Health
88 Services of hospitals that commit certain violations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 241, Health and Safety
1111 Code, is amended by adding Section 241.0555 to read as follows:
1212 Sec. 241.0555. ADDITIONAL REQUIREMENTS: POTENTIALLY
1313 PREVENTABLE ADVERSE EVENTS. (a) If the department finds that a
1414 hospital has committed a violation that resulted in a potentially
1515 preventable adverse event reportable under Chapter 98, as added by
1616 Chapter 359 (Senate Bill No. 288), Acts of the 80th Legislature,
1717 Regular Session, 2007, the department shall require the hospital to
1818 develop and implement a plan for approval by the department to
1919 address the deficiencies that may have contributed to the
2020 preventable adverse event.
2121 (b) The department may require the plan under this section
2222 to include:
2323 (1) staff training and education;
2424 (2) supervision requirements for certain staff;
2525 (3) increased staffing requirements;
2626 (4) increased reporting to the department; and
2727 (5) a review and amendment of hospital policies
2828 relating to patient safety.
2929 (c) The department shall carefully and frequently monitor
3030 the hospital's adherence to the plan under this section and enforce
3131 compliance.
3232 SECTION 2. The change in law made by this Act applies to a
3333 potentially preventable adverse event that occurs on or after the
3434 effective date of this Act.
3535 SECTION 3. This Act takes effect September 1, 2013.
