| 8 | 8 | | Services of hospitals that commit certain violations. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 241, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 241.0555 to read as follows: |
|---|
| 12 | 12 | | Sec. 241.0555. ADDITIONAL REQUIREMENTS: POTENTIALLY |
|---|
| 13 | 13 | | PREVENTABLE ADVERSE EVENTS. (a) If the department finds that a |
|---|
| 14 | 14 | | hospital has committed a violation that resulted in a potentially |
|---|
| 15 | 15 | | preventable adverse event reportable under Chapter 98, as added by |
|---|
| 16 | 16 | | Chapter 359 (Senate Bill No. 288), Acts of the 80th Legislature, |
|---|
| 17 | 17 | | Regular Session, 2007, the department shall require the hospital to |
|---|
| 18 | 18 | | develop and implement a plan for approval by the department to |
|---|
| 19 | 19 | | address the deficiencies that may have contributed to the |
|---|
| 20 | 20 | | preventable adverse event. |
|---|
| 21 | 21 | | (b) The department may require the plan under this section |
|---|
| 22 | 22 | | to include: |
|---|
| 23 | 23 | | (1) staff training and education; |
|---|
| 24 | 24 | | (2) supervision requirements for certain staff; |
|---|
| 25 | 25 | | (3) increased staffing requirements; |
|---|
| 26 | 26 | | (4) increased reporting to the department; and |
|---|
| 27 | 27 | | (5) a review and amendment of hospital policies |
|---|
| 28 | 28 | | relating to patient safety. |
|---|
| 29 | 29 | | (c) The department shall carefully and frequently monitor |
|---|
| 30 | 30 | | the hospital's adherence to the plan under this section and enforce |
|---|
| 31 | 31 | | compliance. |
|---|
| 32 | 32 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 33 | 33 | | potentially preventable adverse event that occurs on or after the |
|---|
| 34 | 34 | | effective date of this Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2013. |
