A BILL TO BE ENTITLED
AN ACT
relating to collection of fees for solid waste management in
certain counties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 364, Health and Safety
Code, is amended by adding Section 364.0345 to read as follows:
Sec. 364.0345. SOLID WASTE DISPOSAL SERVICE FEES IN CERTAIN
COUNTIES. (a) This section applies only to a county that contains
an international border and borders the Gulf of Mexico.
(b) If authorized by the commissioners court, the assessor
and collector for the county shall collect a fee for a service
provided under Section 364.034. If a property for which that fee is
collected is subject to property taxation, the assessor and
collector shall include the fee in the tax bill prepared and mailed
as provided by Section 31.01, Tax Code. The tax bill must
separately state the amount of the fee. If the property on which a
fee for a service provided under Section 364.034 is collected is not
subject to taxation, the assessor and collector shall prepare and
mail a bill for the fee at the same time the assessor and collector
prepares and mails tax bills as provided by Section 31.01, Tax Code.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2013.
