13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Subdivision (1), Subsection (a), Section 39.916, |
---|
15 | 15 | | Utilities Code, is amended to read as follows: |
---|
16 | 16 | | (1) "Distributed renewable generation" means electric |
---|
17 | 17 | | generation [with a capacity of not more than 2,000 kilowatts] |
---|
18 | 18 | | provided by a renewable energy technology, as defined by Section |
---|
19 | 19 | | 39.904: |
---|
20 | 20 | | (A) with a capacity of not more than 2,000 |
---|
21 | 21 | | kilowatts[,] that is installed on a retail electric customer's side |
---|
22 | 22 | | of the meter; |
---|
23 | 23 | | (B) with a capacity of not more than five |
---|
24 | 24 | | megawatts that is installed on a retail electric customer's side of |
---|
25 | 25 | | the meter and is located on land or in a facility owned by this state |
---|
26 | 26 | | or a school district; or |
---|
27 | 27 | | (C) with a capacity of not more than 10 megawatts |
---|
28 | 28 | | that is installed on land or in a facility owned by the federal |
---|
29 | 29 | | government. |
---|
30 | 30 | | SECTION 2. Subsection (b), Section 39.916, Utilities Code, |
---|
31 | 31 | | is amended to read as follows: |
---|
32 | 32 | | (b) A transmission and distribution utility or electric |
---|
33 | 33 | | utility shall allow interconnection if: |
---|
34 | 34 | | (1) the distributed renewable generation to be |
---|
35 | 35 | | interconnected has a five-year warranty against breakdown or undue |
---|
36 | 36 | | degradation; [and] |
---|
37 | 37 | | (2) the rated capacity of the distributed renewable |
---|
38 | 38 | | generation does not exceed the transmission and distribution |
---|
39 | 39 | | utility or electric utility service capacity; and |
---|
40 | 40 | | (3) for distributed renewable generation described by |
---|
41 | 41 | | Subsection (a)(1)(B) or (C), the commission has not made a finding |
---|
42 | 42 | | that the interconnection of the generation will impair reliability |
---|
43 | 43 | | or increase customer costs. |
---|
44 | 44 | | SECTION 3. As soon as practicable after the effective date |
---|
45 | 45 | | of this Act, the Public Utility Commission of Texas shall adopt and |
---|
46 | 46 | | implement rules as necessary to accommodate the interconnection of |
---|
47 | 47 | | distributed renewable generation described by Paragraphs (B) and |
---|
48 | 48 | | (C), Subdivision (1), Subsection (a), Section 39.916, Utilities |
---|
49 | 49 | | Code, as added by this Act, to an electricity distribution system. |
---|
50 | 50 | | SECTION 4. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2013. |
