1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to distributed renewable generation of electricity.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subdivision (1), Subsection (a), Section 39.916,
1515 Utilities Code, is amended to read as follows:
1616 (1) "Distributed renewable generation" means electric
1717 generation [with a capacity of not more than 2,000 kilowatts]
1818 provided by a renewable energy technology, as defined by Section
1919 39.904:
2020 (A) with a capacity of not more than 2,000
2121 kilowatts[,] that is installed on a retail electric customer's side
2222 of the meter;
2323 (B) with a capacity of not more than five
2424 megawatts that is installed on a retail electric customer's side of
2525 the meter and is located on land or in a facility owned by this state
2626 or a school district; or
2727 (C) with a capacity of not more than 10 megawatts
2828 that is installed on land or in a facility owned by the federal
2929 government.
3030 SECTION 2. Subsection (b), Section 39.916, Utilities Code,
3131 is amended to read as follows:
3232 (b) A transmission and distribution utility or electric
3333 utility shall allow interconnection if:
3434 (1) the distributed renewable generation to be
3535 interconnected has a five-year warranty against breakdown or undue
3636 degradation; [and]
3737 (2) the rated capacity of the distributed renewable
3838 generation does not exceed the transmission and distribution
3939 utility or electric utility service capacity; and
4040 (3) for distributed renewable generation described by
4141 Subsection (a)(1)(B) or (C), the commission has not made a finding
4242 that the interconnection of the generation will impair reliability
4343 or increase customer costs.
4444 SECTION 3. As soon as practicable after the effective date
4545 of this Act, the Public Utility Commission of Texas shall adopt and
4646 implement rules as necessary to accommodate the interconnection of
4747 distributed renewable generation described by Paragraphs (B) and
4848 (C), Subdivision (1), Subsection (a), Section 39.916, Utilities
4949 Code, as added by this Act, to an electricity distribution system.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2013.
