13 | 13 | | SECTION 1. Subtitle C, Title 4, Special District Local Laws |
---|
14 | 14 | | Code, is amended by adding Chapter 3862 to read as follows: |
---|
15 | 15 | | CHAPTER 3862. CENTRAL LAREDO MUNICIPAL MANAGEMENT DISTRICT |
---|
16 | 16 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
17 | 17 | | Sec. 3862.001. DEFINITIONS. In this chapter: |
---|
18 | 18 | | (1) "Board" means the district's board of directors. |
---|
19 | 19 | | (2) "City" means the City of Laredo, Texas. |
---|
20 | 20 | | (3) "Director" means a board member. |
---|
21 | 21 | | (4) "District" means the Central Laredo Municipal |
---|
22 | 22 | | Management District. |
---|
23 | 23 | | Sec. 3862.002. CREATION AND NATURE OF DISTRICT. The |
---|
24 | 24 | | district is a special district created under Section 59, Article |
---|
25 | 25 | | XVI, Texas Constitution. |
---|
26 | 26 | | Sec. 3862.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The |
---|
27 | 27 | | creation of the district is essential to accomplish the purposes of |
---|
28 | 28 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
29 | 29 | | Texas Constitution, and other public purposes stated in this |
---|
30 | 30 | | chapter. By creating the district and in authorizing the city and |
---|
31 | 31 | | other political subdivisions to contract with the district, the |
---|
32 | 32 | | legislature has established a program to accomplish the public |
---|
33 | 33 | | purposes set out in Section 52-a, Article III, Texas Constitution. |
---|
34 | 34 | | (b) The creation of the district is necessary to promote, |
---|
35 | 35 | | develop, encourage, and maintain employment, commerce, |
---|
36 | 36 | | transportation, housing, tourism, recreation, the arts, |
---|
37 | 37 | | entertainment, economic development, safety, and the public |
---|
38 | 38 | | welfare in the district. |
---|
39 | 39 | | (c) The district is created to supplement and not to |
---|
40 | 40 | | supplant city services provided in the district. |
---|
41 | 41 | | Sec. 3862.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. |
---|
42 | 42 | | (a) The district is created to serve a public use and benefit. |
---|
43 | 43 | | (b) All land and other property included in the district |
---|
44 | 44 | | will benefit from the improvements and services to be provided by |
---|
45 | 45 | | the district under powers conferred by Sections 52 and 52-a, |
---|
46 | 46 | | Article III, and Section 59, Article XVI, Texas Constitution, and |
---|
47 | 47 | | other powers granted under this chapter. |
---|
48 | 48 | | (c) The creation of the district is in the public interest |
---|
49 | 49 | | and is essential to further the public purposes of: |
---|
50 | 50 | | (1) developing and diversifying the economy of the |
---|
51 | 51 | | state; |
---|
52 | 52 | | (2) eliminating unemployment and underemployment; |
---|
53 | 53 | | (3) developing or expanding transportation and |
---|
54 | 54 | | commerce; and |
---|
55 | 55 | | (4) providing quality residential housing. |
---|
56 | 56 | | (d) The district will: |
---|
57 | 57 | | (1) promote the health, safety, and general welfare of |
---|
58 | 58 | | residents, employers, potential employees, employees, visitors, |
---|
59 | 59 | | and consumers in the district, and of the public; |
---|
60 | 60 | | (2) provide needed funding for the district to |
---|
61 | 61 | | preserve, maintain, and enhance the economic health and vitality of |
---|
62 | 62 | | the district territory as a residential community and business |
---|
63 | 63 | | center; and |
---|
64 | 64 | | (3) promote the health, safety, welfare, and enjoyment |
---|
65 | 65 | | of the public by providing pedestrian ways and by landscaping, |
---|
66 | 66 | | removing graffiti, and developing certain areas in the district, |
---|
67 | 67 | | which are necessary for the restoration, preservation, and |
---|
68 | 68 | | enhancement of scenic beauty. |
---|
69 | 69 | | (e) Pedestrian ways along or across a street, whether at |
---|
70 | 70 | | grade or above or below the surface, and street lighting, street |
---|
71 | 71 | | landscaping, vehicle parking, and street art objects are parts of |
---|
72 | 72 | | and necessary components of a street and are considered to be an |
---|
73 | 73 | | improvement project that includes a street or road improvement. |
---|
74 | 74 | | (f) The district will not act as the agent or |
---|
75 | 75 | | instrumentality of any private interest even though the district |
---|
76 | 76 | | will benefit many private interests as well as the public. |
---|
77 | 77 | | Sec. 3862.005. DISTRICT TERRITORY. (a) The district is |
---|
78 | 78 | | initially composed of the territory described by Section 2 of the |
---|
79 | 79 | | Act enacting this chapter. |
---|
80 | 80 | | (b) The boundaries and field notes contained in Section 2 of |
---|
81 | 81 | | the Act enacting this chapter form a closure. A mistake in the |
---|
82 | 82 | | field notes or in copying the field notes in the legislative process |
---|
83 | 83 | | does not affect the district's: |
---|
84 | 84 | | (1) organization, existence, or validity; |
---|
85 | 85 | | (2) right to issue any type of bond for the purposes |
---|
86 | 86 | | for which the district is created or to pay the principal of and |
---|
87 | 87 | | interest on the bond; |
---|
88 | 88 | | (3) right to impose or collect an assessment or tax; or |
---|
89 | 89 | | (4) legality or operation. |
---|
90 | 90 | | Sec. 3862.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES. |
---|
91 | 91 | | (a) All or any part of the area of the district is eligible to be |
---|
92 | 92 | | included in: |
---|
93 | 93 | | (1) a tax increment reinvestment zone created under |
---|
94 | 94 | | Chapter 311, Tax Code; |
---|
95 | 95 | | (2) a tax abatement reinvestment zone created under |
---|
96 | 96 | | Chapter 312, Tax Code; |
---|
97 | 97 | | (3) an enterprise zone created under Chapter 2303, |
---|
98 | 98 | | Government Code; or |
---|
99 | 99 | | (4) an industrial district created under Chapter 42, |
---|
100 | 100 | | Local Government Code. |
---|
101 | 101 | | (b) If the city creates a tax increment reinvestment zone |
---|
102 | 102 | | described by Subsection (a), the city and the board of directors of |
---|
103 | 103 | | the zone, by contract with the district, may grant money deposited |
---|
104 | 104 | | in the tax increment fund to the district to be used by the district |
---|
105 | 105 | | for the purposes permitted for money granted to a corporation under |
---|
106 | 106 | | Section 380.002(b), Local Government Code, including the right to |
---|
107 | 107 | | pledge the money as security for any bonds issued by the district |
---|
108 | 108 | | for an improvement project. A project may not receive public funds |
---|
109 | 109 | | under Section 380.002(b), Local Government Code, unless the project |
---|
110 | 110 | | has been approved by the governing body of the city. |
---|
111 | 111 | | (c) A tax increment reinvestment zone created by the city in |
---|
112 | 112 | | the district is not subject to the limitations provided by Section |
---|
113 | 113 | | 311.006(b), Tax Code. |
---|
114 | 114 | | Sec. 3862.007. APPLICABILITY OF MUNICIPAL MANAGEMENT |
---|
115 | 115 | | DISTRICTS LAW. Except as otherwise provided by this chapter, |
---|
116 | 116 | | Chapter 375, Local Government Code, applies to the district. |
---|
117 | 117 | | Sec. 3862.008. LIBERAL CONSTRUCTION OF CHAPTER. This |
---|
118 | 118 | | chapter shall be liberally construed in conformity with the |
---|
119 | 119 | | findings and purposes stated in this chapter. |
---|
120 | 120 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
121 | 121 | | Sec. 3862.051. GOVERNING BODY; TERMS. The district is |
---|
122 | 122 | | governed by a board of nine directors who serve staggered terms of |
---|
123 | 123 | | four years expiring June 1 of each odd-numbered year. |
---|
124 | 124 | | Sec. 3862.052. QUALIFICATIONS OF DIRECTORS APPOINTED BY |
---|
125 | 125 | | CITY. (a) To be qualified to serve as a director appointed by the |
---|
126 | 126 | | governing body of the city, a person must be: |
---|
127 | 127 | | (1) a resident of the district who is also a registered |
---|
128 | 128 | | voter of the district; |
---|
129 | 129 | | (2) an owner of property in the district; |
---|
130 | 130 | | (3) an owner of stock or a partnership or membership |
---|
131 | 131 | | interest, whether beneficial or otherwise, of a corporate |
---|
132 | 132 | | partnership, limited liability company, or other entity owner of a |
---|
133 | 133 | | direct or indirect interest in property in the district; |
---|
134 | 134 | | (4) an owner of a beneficial interest in a trust, or a |
---|
135 | 135 | | trustee in a trust, that directly or indirectly owns property in the |
---|
136 | 136 | | district; or |
---|
137 | 137 | | (5) an agent, employee, or tenant of a person |
---|
138 | 138 | | described by Subdivision (2), (3), or (4). |
---|
139 | 139 | | (b) Section 49.052, Water Code, does not apply to the |
---|
140 | 140 | | district. |
---|
141 | 141 | | Sec. 3862.053. APPOINTMENT OF DIRECTORS. The governing |
---|
142 | 142 | | body of the city shall appoint directors from persons recommended |
---|
143 | 143 | | by the board. |
---|
144 | 144 | | Sec. 3862.054. VACANCY. If a vacancy occurs on the board, |
---|
145 | 145 | | the remaining directors shall appoint a director for the remainder |
---|
146 | 146 | | of the unexpired term. |
---|
147 | 147 | | Sec. 3862.055. DIRECTOR'S OATH OR AFFIRMATION. (a) A |
---|
148 | 148 | | director shall file the director's oath or affirmation of office |
---|
149 | 149 | | with the district, and the district shall retain the oath or |
---|
150 | 150 | | affirmation in the district records. |
---|
151 | 151 | | (b) A director shall file a copy of the director's oath or |
---|
152 | 152 | | affirmation with the secretary of the city. |
---|
153 | 153 | | Sec. 3862.056. QUORUM. A vacant director position is not |
---|
154 | 154 | | counted for purposes of establishing a quorum. |
---|
155 | 155 | | Sec. 3862.057. OFFICERS. The board shall elect from among |
---|
156 | 156 | | the directors a chair, a vice chair, and a secretary. The offices |
---|
157 | 157 | | of chair and secretary may not be held by the same person. |
---|
158 | 158 | | Sec. 3862.058. COMPENSATION; EXPENSES. (a) The district |
---|
159 | 159 | | may compensate each director in an amount not to exceed $50 for each |
---|
160 | 160 | | board meeting. The total amount of compensation for each director |
---|
161 | 161 | | in one year may not exceed $2,000. |
---|
162 | 162 | | (b) A director is entitled to reimbursement for necessary |
---|
163 | 163 | | and reasonable expenses incurred in carrying out the duties and |
---|
164 | 164 | | responsibilities of the board. |
---|
165 | 165 | | Sec. 3862.059. LIABILITY INSURANCE. The district may |
---|
166 | 166 | | obtain and pay for comprehensive general liability insurance |
---|
167 | 167 | | coverage from a commercial insurance company or other source that |
---|
168 | 168 | | protects and insures a director against personal liability and from |
---|
169 | 169 | | all claims relating to: |
---|
170 | 170 | | (1) actions taken by the director in the director's |
---|
171 | 171 | | capacity as a member of the board; |
---|
172 | 172 | | (2) actions and activities taken by the district; or |
---|
173 | 173 | | (3) the actions of others acting on behalf of the |
---|
174 | 174 | | district. |
---|
175 | 175 | | Sec. 3862.060. NO EXECUTIVE COMMITTEE. The board may not |
---|
176 | 176 | | create an executive committee to exercise the powers of the board. |
---|
177 | 177 | | Sec. 3862.061. BOARD MEETINGS. The board shall hold |
---|
178 | 178 | | meetings at a place accessible to the public. |
---|
179 | 179 | | Sec. 3862.062. INITIAL DIRECTORS. (a) The initial board |
---|

---|
198 | 198 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
199 | 199 | | Sec. 3862.101. GENERAL POWERS AND DUTIES. The district has |
---|
200 | 200 | | the powers and duties necessary to accomplish the purposes for |
---|
201 | 201 | | which the district is created. |
---|
202 | 202 | | Sec. 3862.102. IMPROVEMENT PROJECTS AND SERVICES. (a) The |
---|
203 | 203 | | district may provide, design, construct, acquire, improve, |
---|
204 | 204 | | relocate, operate, maintain, or finance an improvement project or |
---|
205 | 205 | | service using money available to the district, or contract with a |
---|
206 | 206 | | governmental or private entity to provide, design, construct, |
---|
207 | 207 | | acquire, improve, relocate, operate, maintain, or finance an |
---|
208 | 208 | | improvement project or service authorized under this chapter or |
---|
209 | 209 | | Chapter 375, Local Government Code. |
---|
210 | 210 | | (b) An improvement project described by Subsection (a) may |
---|
211 | 211 | | be located: |
---|
212 | 212 | | (1) in the district; or |
---|
213 | 213 | | (2) in an area outside but adjacent to the district if |
---|
214 | 214 | | the project is for the purpose of extending a public infrastructure |
---|
215 | 215 | | improvement beyond the district's boundaries to a logical terminus. |
---|
216 | 216 | | Sec. 3862.103. DEVELOPMENT CORPORATION POWERS. The |
---|
217 | 217 | | district, using money available to the district, may exercise the |
---|
218 | 218 | | powers given to a development corporation under Chapter 505, Local |
---|
219 | 219 | | Government Code, including the power to own, operate, acquire, |
---|
220 | 220 | | construct, lease, improve, or maintain a project under that |
---|
221 | 221 | | chapter. |
---|
222 | 222 | | Sec. 3862.104. NONPROFIT CORPORATION. (a) The board by |
---|
223 | 223 | | resolution may authorize the creation of a nonprofit corporation to |
---|
224 | 224 | | assist and act for the district in implementing a project or |
---|
225 | 225 | | providing a service authorized by this chapter. |
---|
226 | 226 | | (b) The nonprofit corporation: |
---|
227 | 227 | | (1) has each power of and is considered to be a local |
---|
228 | 228 | | government corporation created under Subchapter D, Chapter 431, |
---|
229 | 229 | | Transportation Code; and |
---|
230 | 230 | | (2) may implement any project and provide any service |
---|
231 | 231 | | authorized by this chapter. |
---|
232 | 232 | | (c) The board shall appoint the board of directors of the |
---|
233 | 233 | | nonprofit corporation. The board of directors of the nonprofit |
---|
234 | 234 | | corporation shall serve in the same manner as the board of directors |
---|
235 | 235 | | of a local government corporation created under Subchapter D, |
---|
236 | 236 | | Chapter 431, Transportation Code, except that a board member is not |
---|
237 | 237 | | required to reside in the district. |
---|
238 | 238 | | Sec. 3862.105. AGREEMENTS; GRANTS. (a) As provided by |
---|
239 | 239 | | Chapter 375, Local Government Code, the district may make an |
---|
240 | 240 | | agreement with or accept a gift, grant, or loan from any person. |
---|
241 | 241 | | (b) The implementation of a project is a governmental |
---|
242 | 242 | | function or service for the purposes of Chapter 791, Government |
---|
243 | 243 | | Code. |
---|
244 | 244 | | Sec. 3862.106. LAW ENFORCEMENT SERVICES. To protect the |
---|
245 | 245 | | public interest, the district may contract with a qualified party, |
---|
246 | 246 | | including Webb County or the city, to provide law enforcement |
---|
247 | 247 | | services in the district for a fee. |
---|
248 | 248 | | Sec. 3862.107. MEMBERSHIP IN CHARITABLE ORGANIZATIONS. The |
---|
249 | 249 | | district may join and pay dues to a charitable or nonprofit |
---|
250 | 250 | | organization that performs a service or provides an activity |
---|
251 | 251 | | consistent with the furtherance of a district purpose. |
---|
252 | 252 | | Sec. 3862.108. ECONOMIC DEVELOPMENT. (a) The district may |
---|
253 | 253 | | engage in activities that accomplish the economic development |
---|
254 | 254 | | purposes of the district. |
---|
255 | 255 | | (b) The district may establish and provide for the |
---|
256 | 256 | | administration of one or more programs to promote state or local |
---|
257 | 257 | | economic development and to stimulate business and commercial |
---|
258 | 258 | | activity in the district, including programs to: |
---|
259 | 259 | | (1) make loans and grants of public money; and |
---|
260 | 260 | | (2) provide district personnel and services. |
---|
261 | 261 | | (c) The district may create economic development programs |
---|
262 | 262 | | and exercise the economic development powers that: |
---|
263 | 263 | | (1) Chapter 380, Local Government Code, provides to a |
---|
264 | 264 | | municipality; and |
---|
265 | 265 | | (2) Subchapter A, Chapter 1509, Government Code, |
---|
266 | 266 | | provides to a municipality. |
---|
267 | 267 | | Sec. 3862.109. PARKING FACILITIES. (a) The district may |
---|
268 | 268 | | acquire, lease as lessor or lessee, construct, develop, own, |
---|
269 | 269 | | operate, and maintain parking facilities or a system of parking |
---|
270 | 270 | | facilities, including lots, garages, parking terminals, or other |
---|
271 | 271 | | structures or accommodations for parking motor vehicles off the |
---|
272 | 272 | | streets and related appurtenances. |
---|
273 | 273 | | (b) The district's parking facilities serve the public |
---|
274 | 274 | | purposes of the district and are owned, used, and held for a public |
---|
275 | 275 | | purpose even if leased or operated by a private entity for a term of |
---|
276 | 276 | | years. |
---|
277 | 277 | | (c) The district's parking facilities are necessary |
---|
278 | 278 | | components of a street and are considered to be a street or road |
---|
279 | 279 | | improvement. |
---|
280 | 280 | | (d) The development and operation of the district's parking |
---|
281 | 281 | | facilities may be considered an economic development program. |
---|
282 | 282 | | Sec. 3862.110. NO EMINENT DOMAIN POWER. The district may |
---|
283 | 283 | | not exercise the power of eminent domain. |
---|
284 | 284 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS; ASSESSMENTS |
---|
285 | 285 | | Sec. 3862.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The |
---|
286 | 286 | | board by resolution shall establish the number of signatures and |
---|
287 | 287 | | the procedure required for a disbursement or transfer of the |
---|
288 | 288 | | district's money. |
---|
289 | 289 | | Sec. 3862.152. MONEY USED FOR IMPROVEMENTS OR SERVICES. |
---|
290 | 290 | | The district may acquire, construct, finance, operate, or maintain |
---|
291 | 291 | | an improvement project or service authorized under this chapter or |
---|
292 | 292 | | Chapter 375, Local Government Code, using any money available to |
---|
293 | 293 | | the district. |
---|
294 | 294 | | Sec. 3862.153. PETITION REQUIRED FOR FINANCING SERVICES AND |
---|
295 | 295 | | IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a |
---|
296 | 296 | | service or improvement project with assessments under this chapter |
---|
297 | 297 | | unless a written petition requesting that service or improvement |
---|
298 | 298 | | has been filed with the board. |
---|
299 | 299 | | (b) The petition must be signed by: |
---|
300 | 300 | | (1) the owners of a majority of the assessed value of |
---|
301 | 301 | | real property in the district subject to assessment according to |
---|
302 | 302 | | the most recent certified tax appraisal roll for Webb County; or |
---|
303 | 303 | | (2) at least 25 persons who own real property in the |
---|
304 | 304 | | district subject to assessment, if more than 25 persons own real |
---|
305 | 305 | | property in the district subject to assessment as determined by the |
---|
306 | 306 | | most recent certified tax appraisal roll for Webb County. |
---|
307 | 307 | | Sec. 3862.154. METHOD OF NOTICE FOR HEARING. The district |
---|
308 | 308 | | may mail the notice required by Section 375.115(c), Local |
---|
309 | 309 | | Government Code, by certified or first class United States mail. |
---|
310 | 310 | | The board shall determine the method of notice. |
---|
311 | 311 | | Sec. 3862.155. ASSESSMENTS; LIENS FOR ASSESSMENTS. |
---|
312 | 312 | | (a) The board by resolution may impose and collect an assessment |
---|
313 | 313 | | for any purpose authorized by this chapter in all or any part of the |
---|
314 | 314 | | district. |
---|
315 | 315 | | (b) An assessment, a reassessment, or an assessment |
---|
316 | 316 | | resulting from an addition to or correction of the assessment roll |
---|
317 | 317 | | by the district, penalties and interest on an assessment or |
---|
318 | 318 | | reassessment, an expense of collection, and reasonable attorney's |
---|
319 | 319 | | fees incurred by the district: |
---|
320 | 320 | | (1) are a first and prior lien against the property |
---|
321 | 321 | | assessed; |
---|
322 | 322 | | (2) are superior to any other lien or claim other than |
---|
323 | 323 | | a lien or claim for county, school district, or municipal ad valorem |
---|
324 | 324 | | taxes; and |
---|
325 | 325 | | (3) are the personal liability of and a charge against |
---|
326 | 326 | | the owners of the property even if the owners are not named in the |
---|
327 | 327 | | assessment proceedings. |
---|
328 | 328 | | (c) The lien is effective from the date of the board's |
---|
329 | 329 | | resolution imposing the assessment until the date the assessment is |
---|
330 | 330 | | paid. The board may enforce the lien in the same manner that the |
---|
331 | 331 | | board may enforce an ad valorem tax lien against real property. |
---|
332 | 332 | | (d) The board may make a correction to or deletion from the |
---|
333 | 333 | | assessment roll that does not increase the amount of assessment of |
---|
334 | 334 | | any parcel of land without providing notice and holding a hearing in |
---|
335 | 335 | | the manner required for additional assessments. |
---|
336 | 336 | | Sec. 3862.156. LIMITATION ON AMOUNT OF CERTAIN ASSESSMENTS. |
---|
337 | 337 | | An assessment based on the taxable value of real property may not |
---|
338 | 338 | | exceed 20 cents per $100 of assessed valuation of taxable property |
---|
339 | 339 | | in the district, according to the most recent certified tax |
---|
340 | 340 | | appraisal roll for Webb County. |
---|

381 | 381 | | Sec. 3862.251. DISSOLUTION BY CITY ORDINANCE. (a) The |

382 | 382 | | city by ordinance may dissolve the district. |
---|
383 | 383 | | (b) The city may not dissolve the district until the |

384 | 384 | | district's outstanding debt or contractual obligations that are |
---|
385 | 385 | | payable from ad valorem taxes have been repaid or discharged, or the |

386 | 386 | | city has affirmatively assumed the obligation to pay the |
---|
387 | 387 | | outstanding debt from city revenue. |

388 | 388 | | Sec. 3862.252. COLLECTION OF ASSESSMENTS AND OTHER REVENUE. |

389 | 389 | | (a) If the dissolved district has bonds or other obligations |

391 | 391 | | revenue, other than ad valorem taxes, the city shall succeed to the |

401 | 401 | | Sec. 3862.253. CONCURRENCE ON ADDITIONAL POWERS. If the |

404 | 404 | | the city consenting to the creation of the district, the district |
---|
