1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the punishment for the offense of prostitution.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subsection (c), Section 43.02, Penal Code, is
1515 amended to read as follows:
1616 (c) An offense under this section is a Class B misdemeanor,
1717 except that the offense is:
1818 (1) a Class A misdemeanor if the defendant [actor] has
1919 previously been convicted one or two times of an offense under this
2020 section;
2121 (2) for a defendant who received or was to receive a
2222 fee:
2323 (A) a Class A misdemeanor with a minimum term of
2424 confinement of 90 days if the defendant has previously been
2525 convicted three or more times but fewer than eight times of an
2626 offense under this section; or
2727 (B) a state jail felony if the defendant has
2828 previously been convicted eight or more times of an offense under
2929 this section; or
3030 (3) for a defendant who paid or was to pay a fee:
3131 (A) a state jail felony if the defendant [actor]
3232 has previously been convicted three or more times of an offense
3333 under this section;
3434 (B) [(3)] a felony of the third degree if the
3535 person with respect to whom the fee was paid or to be paid
3636 [solicited] is 14 years of age or older and younger than 18 years of
3737 age; or
3838 (C) [(4)] a felony of the second degree if the
3939 person with respect to whom the fee was paid or to be paid
4040 [solicited] is younger than 14 years of age.
4141 SECTION 2. The change in law made by this Act applies only
4242 to an offense committed on or after the effective date of this Act.
4343 An offense committed before the effective date of this Act is
4444 governed by the law in effect on the date the offense was committed,
4545 and the former law is continued in effect for that purpose. For
4646 purposes of this section, an offense was committed before the
4747 effective date of this Act if any element of the offense occurred
4848 before that date.
4949 SECTION 3. This Act takes effect September 1, 2013.
