88 possession of a license plate flipper; creating an offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter L, Chapter 504, Transportation Code,
1111 is amended by adding Section 504.946 to read as follows:
1212 Sec. 504.946. LICENSE PLATE FLIPPER; OFFENSE. (a) In this
1313 section, "license plate flipper" means a manual, electronic, or
1414 mechanical device designed or adapted to be installed on a motor
1515 vehicle and:
1616 (1) switch between two or more license plates for the
1717 purpose of allowing a motor vehicle operator to change the license
1818 plate displayed on the operator's vehicle; or
1919 (2) hide a license plate from view by flipping the
2020 license plate so that the license plate number is not visible.
2121 (b) A person commits an offense if the person with criminal
2222 negligence purchases or possesses a license plate flipper. An
2323 offense under this subsection is a Class B misdemeanor.
2424 (c) A person commits an offense if the person with criminal
2525 negligence manufactures, sells, offers to sell, or otherwise
2626 distributes a license plate flipper. An offense under this
2727 subsection is a Class A misdemeanor.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2013.
