| 8 | 8 | | possession of a license plate flipper; creating an offense. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter L, Chapter 504, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 504.946 to read as follows: |
|---|
| 12 | 12 | | Sec. 504.946. LICENSE PLATE FLIPPER; OFFENSE. (a) In this |
|---|
| 13 | 13 | | section, "license plate flipper" means a manual, electronic, or |
|---|
| 14 | 14 | | mechanical device designed or adapted to be installed on a motor |
|---|
| 15 | 15 | | vehicle and: |
|---|
| 16 | 16 | | (1) switch between two or more license plates for the |
|---|
| 17 | 17 | | purpose of allowing a motor vehicle operator to change the license |
|---|
| 18 | 18 | | plate displayed on the operator's vehicle; or |
|---|
| 19 | 19 | | (2) hide a license plate from view by flipping the |
|---|
| 20 | 20 | | license plate so that the license plate number is not visible. |
|---|
| 21 | 21 | | (b) A person commits an offense if the person with criminal |
|---|
| 22 | 22 | | negligence purchases or possesses a license plate flipper. An |
|---|
| 23 | 23 | | offense under this subsection is a Class B misdemeanor. |
|---|
| 24 | 24 | | (c) A person commits an offense if the person with criminal |
|---|
| 25 | 25 | | negligence manufactures, sells, offers to sell, or otherwise |
|---|
| 26 | 26 | | distributes a license plate flipper. An offense under this |
|---|
| 27 | 27 | | subsection is a Class A misdemeanor. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2013. |
