14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Subtitle C, Title 9, Health and Safety Code, is |
---|
16 | 16 | | amended by adding Chapter 797 to read as follows: |
---|
17 | 17 | | CHAPTER 797. WILDFIRE PREVENTION |
---|
18 | 18 | | Sec. 797.001. DEFINITIONS. In this chapter: |
---|
19 | 19 | | (1) "Director" means the director of the Texas A&M |
---|
20 | 20 | | Forest Service. |
---|
21 | 21 | | (2) "Wildfire" and "wildland" have the meanings |
---|
22 | 22 | | assigned by Section 88.1015, Education Code. |
---|
23 | 23 | | (3) "Wildland-urban interface" means a place where an |
---|
24 | 24 | | urban area and wildland meet and that: |
---|
25 | 25 | | (A) is designated by the director to be an |
---|
26 | 26 | | at-risk area for wildfires; or |
---|
27 | 27 | | (B) is an area within one-half mile of a place |
---|
28 | 28 | | described by Paragraph (A). |

29 | 29 | | Sec. 797.002. FIRE HYDRANT REQUIREMENTS FOR WILDLAND-URBAN |
---|
30 | 30 | | INTERFACE. (a) This section applies only to a municipality with a |
---|
31 | 31 | | population of 2,500 or more, located in a county that has a |
---|
32 | 32 | | population of more than one million and less than 1.5 million, that |
---|
33 | 33 | | has within its boundaries a wildland-urban interface. |
---|
34 | 34 | | (b) A governing body of a municipality may by ordinance |
---|
35 | 35 | | require a fire hydrant located in that municipality to conform to |
---|
36 | 36 | | flow and pressure standards established by the ordinance. |
---|
37 | 37 | | (c) A municipality may consult with county and state fire |
---|
38 | 38 | | prevention agencies in adopting standards under Subsection (b). |
---|
39 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
---|
40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 43 | | Act takes effect September 1, 2013. |
