1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the adoption of fire hydrant requirements for a
1313 wildland-urban interface in certain municipalities.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subtitle C, Title 9, Health and Safety Code, is
1616 amended by adding Chapter 797 to read as follows:
1717 CHAPTER 797. WILDFIRE PREVENTION
1818 Sec. 797.001. DEFINITIONS. In this chapter:
1919 (1) "Director" means the director of the Texas A&M
2020 Forest Service.
2121 (2) "Wildfire" and "wildland" have the meanings
2222 assigned by Section 88.1015, Education Code.
2323 (3) "Wildland-urban interface" means a place where an
2424 urban area and wildland meet and that:
2525 (A) is designated by the director to be an
2626 at-risk area for wildfires; or
2727 (B) is an area within one-half mile of a place
2828 described by Paragraph (A).
2929 Sec. 797.002. FIRE HYDRANT REQUIREMENTS FOR WILDLAND-URBAN
3030 INTERFACE. (a) This section applies only to a municipality with a
3131 population of 2,500 or more, located in a county that has a
3232 population of more than one million and less than 1.5 million, that
3333 has within its boundaries a wildland-urban interface.
3434 (b) A governing body of a municipality may by ordinance
3535 require a fire hydrant located in that municipality to conform to
3636 flow and pressure standards established by the ordinance.
3737 (c) A municipality may consult with county and state fire
3838 prevention agencies in adopting standards under Subsection (b).
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2013.
