AUTHOR'S / SPONSOR'S STATEMENT OF INTENT In honor of fallen service members who have paid the ultimate price, S.B. 1807 requires that flags at state office buildings be flown at half-staff following the death of a soldier killed in action. S.B. 1807 requires that the United States flag and the Texas state flag be displayed at half-staff at each state office building, including the state capitol, after the death of a member of the armed forces who was a resident of Texas and killed in action. The day after the family has been notified of the soldier's death, the flags will be displayed at half-staff for one day. State agencies, including the State Preservation Board, will be notified by the Office of the Governor on which days the flags shall be flown at half-staff. As proposed, S.B. 1807 amends current law relating to the display of flags at half-staff at state buildings to honor service members killed in action. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 443.024, Government Code, by adding Subsection (e), to require that the flag of the State of Texas and the flag of the United States be flown at half-staff at the Capitol building on the days specified by Section 2165.0061. SECTION 2. Amends Subchapter A, Chapter 2165, Government Code, by adding Section 2165.0061, as follows: Sec. 2165.0061. DISPLAY OF FLAGS AT HALF-STAFF. Requires that the state flag and the flag of the United States be displayed at half-staff at each state office building on the death of a member of the armed forces of the United States who was a resident of this state and who was killed in action. Requires that the flags be displayed at half-staff for one day following the date the person's family is notified of the person's death. Requires that the office of the governor notify state agencies, including the State Preservation Board, of the days on which flags are required to be flown at half-staff under this section. SECTION 3. Effective date: upon passage or September 1, 2013.
