99 AN ACT
1010 relating to the display of flags at half-staff at state buildings to
1111 honor service members killed in action.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 443.024, Government Code, is amended by
1414 adding Subsection (e) to read as follows:
1515 (e) The flag of the State of Texas and the flag of the United
1616 States shall be flown at half-staff at the Capitol building on the
1717 days specified by Section 2165.0061.
1818 SECTION 2. Subchapter A, Chapter 2165, Government Code, is
1919 amended by adding Section 2165.0061 to read as follows:
2020 Sec. 2165.0061. DISPLAY OF FLAGS AT HALF-STAFF. The state
2121 flag and the flag of the United States shall be displayed at
2222 half-staff at each state office building on the death of a member of
2323 the armed forces of the United States who was a resident of this
2424 state and who was killed in action. The flags shall be displayed at
2525 half-staff for one day following the date the person's family is
2626 notified of the person's death. The office of the governor shall
2727 notify state agencies, including the State Preservation Board, of
2828 the days on which flags shall be flown at half-staff under this
2929 section.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2013.
