| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 443.024, Government Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (e) to read as follows: |

| 15 | 15 | | (e) The flag of the State of Texas and the flag of the United |
|---|
| 16 | 16 | | States shall be flown at half-staff at the Capitol building on the |
|---|
| 17 | 17 | | days specified by Section 2165.0061. |

| 18 | 18 | | SECTION 2. Subchapter A, Chapter 2165, Government Code, is |
|---|
| 19 | 19 | | amended by adding Section 2165.0061 to read as follows: |
|---|
| 20 | 20 | | Sec. 2165.0061. DISPLAY OF FLAGS AT HALF-STAFF. The state |
|---|
| 21 | 21 | | flag and the flag of the United States shall be displayed at |
|---|
| 22 | 22 | | half-staff at each state office building on the death of a member of |
|---|
| 23 | 23 | | the armed forces of the United States who was a resident of this |
|---|
| 24 | 24 | | state and who was killed in action. The flags shall be displayed at |
|---|
| 25 | 25 | | half-staff for one day following the date the person's family is |
|---|
| 26 | 26 | | notified of the person's death. The office of the governor shall |
|---|
| 27 | 27 | | notify state agencies, including the State Preservation Board, of |
|---|
| 28 | 28 | | the days on which flags shall be flown at half-staff under this |
|---|
| 29 | 29 | | section. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2013. |
