7 | 7 | | relating to a requirement that members of the Public Safety |

8 | 8 | | Commission hold a secret security clearance. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsection (b), Section 411.003, Government |
---|
11 | 11 | | Code, is amended to read as follows: |
---|
12 | 12 | | (b) The commission is composed of five citizens of this |
---|
13 | 13 | | state appointed by the governor with the advice and consent of the |
---|
14 | 14 | | senate. Members must be selected because of their peculiar |
---|
15 | 15 | | qualifications for the position and must reflect the diverse |
---|
16 | 16 | | geographic regions and population groups of this state. Members |
---|
17 | 17 | | must have and maintain a secret security clearance granted by the |
---|
18 | 18 | | United States government. A member may serve on the commission upon |
---|
19 | 19 | | the granting of an interim secret security clearance, but may not be |
---|
20 | 20 | | given access to classified information, participate in a briefing |
---|
21 | 21 | | involving classified information, or vote on an issue involving |
---|
22 | 22 | | classified information until a secret security clearance has been |
---|
23 | 23 | | finally approved by the United States government. Appointments to |
---|
24 | 24 | | the commission shall be made without regard to race, color, |
---|
25 | 25 | | disability, sex, religion, age, or national origin. In making an |
---|
26 | 26 | | appointment the governor shall consider, among other things, the |
---|
27 | 27 | | person's knowledge of laws, experience in the enforcement of law, |
---|
28 | 28 | | honesty, integrity, education, training, and executive ability. |
---|
29 | 29 | | SECTION 2. The changes in law made by this Act apply to a |
---|
30 | 30 | | member of the Public Safety Commission serving on or after the |
---|
31 | 31 | | effective date of this Act. |
---|
32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2013. |
