77 relating to a requirement that members of the Public Safety
88 Commission hold a secret security clearance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 411.003, Government
1111 Code, is amended to read as follows:
1212 (b) The commission is composed of five citizens of this
1313 state appointed by the governor with the advice and consent of the
1414 senate. Members must be selected because of their peculiar
1515 qualifications for the position and must reflect the diverse
1616 geographic regions and population groups of this state. Members
1717 must have and maintain a secret security clearance granted by the
1818 United States government. A member may serve on the commission upon
1919 the granting of an interim secret security clearance, but may not be
2020 given access to classified information, participate in a briefing
2121 involving classified information, or vote on an issue involving
2222 classified information until a secret security clearance has been
2323 finally approved by the United States government. Appointments to
2424 the commission shall be made without regard to race, color,
2525 disability, sex, religion, age, or national origin. In making an
2626 appointment the governor shall consider, among other things, the
2727 person's knowledge of laws, experience in the enforcement of law,
2828 honesty, integrity, education, training, and executive ability.
2929 SECTION 2. The changes in law made by this Act apply to a
3030 member of the Public Safety Commission serving on or after the
3131 effective date of this Act.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2013.
