7	7	relating to the administration, powers, and duties of the Fort Bend
8	8	County Municipal Utility District No. 134.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subsection (a), Section 2.01, Chapter 1342, Acts
11	11	of the 77th Legislature, Regular Session, 2001, is amended to read
12	12	as follows:
13	13	(a) The district is governed by a board of five directors
14	14	[elected as provided by Section 2.04].
15	15	SECTION 2. Subsection (a), Section 3.015, Chapter 1342,
16	16	Acts of the 77th Legislature, Regular Session, 2001, is amended to
17	17	read as follows:
18	18	(a) To the extent authorized by Section 52, Article III,
19	19	Texas Constitution, the district may construct, acquire, improve,
20	20	maintain, or operate macadamized, graveled, or paved roads or
21	21	turnpikes, or improvements in aid of those roads or turnpikes,
22	22	including entrance and exit ramps to and from State Highway 99, also
23	23	known as the Grand Parkway [inside the district].
24	24	SECTION 3. The heading to Section 7.03, Chapter 1342, Acts
25	25	of the 77th Legislature, Regular Session, 2001, is amended to read
26	26	as follows:
27	27	SECTION 7.03. LAW GOVERNING DIVIDED DISTRICT; APPOINTMENT
28	28	AND ELECTION OF DIRECTORS.
29	29	SECTION 4. Subsections (a) and (e), Section 7.03, Chapter
30	30	1342, Acts of the 77th Legislature, Regular Session, 2001, are
31	31	amended to read as follows:
32	32	(a) A district resulting from a division under this article
33	33	is a separate district and is governed as a separate district. This
34	34	chapter applies to any new district created by the division of the
35	35	district, and a new district has all the powers and duties of the
36	36	district.
37	37	(e) Members of a [A] successor to the board of directors of a
38	38	district resulting from a division under this article shall be
39	39	elected as provided by Section 49.103, Water Code [2.04 of this
40	40	Act].
41	41	SECTION 5. The following sections of Chapter 1342, Acts of
42	42	the 77th Legislature, Regular Session, 2001, are repealed:
43	43	(1) Subsection (c), Section 2.01;
44	44	(2) Section 2.04;
45	45	(3) Subsection (b), Section 2.05;
46	46	(4) Section 2.10;
47	47	(5) Section 5.05; and
48	48	(6) Section 9.02.
49	49	SECTION 6. (a) The legal notice of the intention to
50	50	introduce this Act, setting forth the general substance of this
51	51	Act, has been published as provided by law, and the notice and a
52	52	copy of this Act have been furnished to all persons, agencies,
53	53	officials, or entities to which they are required to be furnished
54	54	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
55	55	Government Code.
56	56	(b) The governor, one of the required recipients, has
57	57	submitted the notice and Act to the Texas Commission on
58	58	Environmental Quality.
59	59	(c) The Texas Commission on Environmental Quality has filed
60	60	its recommendations relating to this Act with the governor, the
61	61	lieutenant governor, and the speaker of the house of
62	62	representatives within the required time.
63	63	(d) All requirements of the constitution and laws of this
64	64	state and the rules and procedures of the legislature with respect
65	65	to the notice, introduction, and passage of this Act are fulfilled
66	66	and accomplished.
67	67	SECTION 7. This Act takes effect immediately if it receives
68	68	a vote of two-thirds of all the members elected to each house, as
69	69	provided by Section 39, Article III, Texas Constitution. If this
70	70	Act does not receive the vote necessary for immediate effect, this
71	71	Act takes effect September 1, 2013.
