77 relating to the administration, powers, and duties of the Fort Bend
88 County Municipal Utility District No. 134.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Section 2.01, Chapter 1342, Acts
1111 of the 77th Legislature, Regular Session, 2001, is amended to read
1212 as follows:
1313 (a) The district is governed by a board of five directors
1414 [elected as provided by Section 2.04].
1515 SECTION 2. Subsection (a), Section 3.015, Chapter 1342,
1616 Acts of the 77th Legislature, Regular Session, 2001, is amended to
1717 read as follows:
1818 (a) To the extent authorized by Section 52, Article III,
1919 Texas Constitution, the district may construct, acquire, improve,
2020 maintain, or operate macadamized, graveled, or paved roads or
2121 turnpikes, or improvements in aid of those roads or turnpikes,
2222 including entrance and exit ramps to and from State Highway 99, also
2323 known as the Grand Parkway [inside the district].
2424 SECTION 3. The heading to Section 7.03, Chapter 1342, Acts
2525 of the 77th Legislature, Regular Session, 2001, is amended to read
2626 as follows:
2727 SECTION 7.03. LAW GOVERNING DIVIDED DISTRICT; APPOINTMENT
2828 AND ELECTION OF DIRECTORS.
2929 SECTION 4. Subsections (a) and (e), Section 7.03, Chapter
3030 1342, Acts of the 77th Legislature, Regular Session, 2001, are
3131 amended to read as follows:
3232 (a) A district resulting from a division under this article
3333 is a separate district and is governed as a separate district. This
3434 chapter applies to any new district created by the division of the
3535 district, and a new district has all the powers and duties of the
3636 district.
3737 (e) Members of a [A] successor to the board of directors of a
3838 district resulting from a division under this article shall be
3939 elected as provided by Section 49.103, Water Code [2.04 of this
4040 Act].
4141 SECTION 5. The following sections of Chapter 1342, Acts of
4242 the 77th Legislature, Regular Session, 2001, are repealed:
4343 (1) Subsection (c), Section 2.01;
4444 (2) Section 2.04;
4545 (3) Subsection (b), Section 2.05;
4646 (4) Section 2.10;
4747 (5) Section 5.05; and
4848 (6) Section 9.02.
4949 SECTION 6. (a) The legal notice of the intention to
5050 introduce this Act, setting forth the general substance of this
5151 Act, has been published as provided by law, and the notice and a
5252 copy of this Act have been furnished to all persons, agencies,
5353 officials, or entities to which they are required to be furnished
5454 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5555 Government Code.
5656 (b) The governor, one of the required recipients, has
5757 submitted the notice and Act to the Texas Commission on
5858 Environmental Quality.
5959 (c) The Texas Commission on Environmental Quality has filed
6060 its recommendations relating to this Act with the governor, the
6161 lieutenant governor, and the speaker of the house of
6262 representatives within the required time.
6363 (d) All requirements of the constitution and laws of this
6464 state and the rules and procedures of the legislature with respect
6565 to the notice, introduction, and passage of this Act are fulfilled
6666 and accomplished.
6767 SECTION 7. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2013.
