77 relating to an additional fee for filing civil cases in certain
88 Rockwall County courts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 51, Government Code, is
1111 amended by adding Section 51.709 to read as follows:
1212 Sec. 51.709. ADDITIONAL FILING FEE FOR CIVIL CASES IN
1313 ROCKWALL COUNTY. (a) This section applies only to district
1414 courts, statutory probate courts, county courts at law, and justice
1515 courts in Rockwall County.
1616 (b) Except as otherwise provided by this section and in
1717 addition to all other fees authorized or required by other law, the
1818 clerk of a court shall collect a filing fee of not more than $15 in
1919 each civil case filed in the court to be used for the construction,
2020 renovation, or improvement of the facilities that house the courts
2121 collecting the fee.
2222 (c) Court fees due under this section shall be collected in
2323 the same manner as other fees, fines, or costs are collected in the
2424 case.
2525 (d) The clerk shall send the fees collected under this
2626 section to the county treasurer at least as frequently as monthly.
2727 The treasurer shall deposit the fees in a special account in the
2828 county treasury dedicated to the construction, renovation, or
2929 improvement of the facilities that house the courts collecting the
3030 fee.
3131 (e) This section applies only to fees for a 12-month period
3232 beginning July 1, if the commissioners court:
3333 (1) adopts a resolution authorizing a fee of not more
3434 than $15; and
3535 (2) files the resolution with the county treasurer not
3636 later than June 1 immediately preceding the first 12-month period
3737 during which the fees are to be collected.
3838 (f) A resolution adopted under Subsection (e) continues
3939 from year to year until July 1, 2025, allowing the county to collect
4040 fees under the terms of this section until the resolution is
4141 rescinded.
4242 (g) The commissioners court may rescind the resolution
4343 adopted under Subsection (e) by adopting a resolution rescinding
4444 the resolution and submitting the recision resolution to the county
4545 treasurer not later than June 1 preceding the beginning of the first
4646 day of the county fiscal year. The commissioners court may adopt an
4747 additional resolution in the manner provided by Subsection (e)
4848 after rescinding a previous resolution under that subsection.
4949 (h) A fee established under a particular resolution is
5050 abolished on the earlier of:
5151 (1) the date a resolution adopted under Subsection (e)
5252 is rescinded as provided by Subsection (g); or
5353 (2) July 1, 2025.
5454 SECTION 2. Subchapter D, Chapter 101, Government Code, is
5555 amended by adding Section 101.061191 to read as follows:
5656 Sec. 101.061191. ADDITIONAL DISTRICT COURT FEES FOR COURT
5757 FACILITIES: GOVERNMENT CODE. The clerk of a district court in
5858 Rockwall County shall collect an additional filing fee of not more
5959 than $15 under Section 51.709 in civil cases to fund the
6060 construction, renovation, or improvement of court facilities, if
6161 authorized by the county commissioners court.
6262 SECTION 3. Subchapter E, Chapter 101, Government Code, is
6363 amended by adding Section 101.08119 to read as follows:
6464 Sec. 101.08119. ADDITIONAL STATUTORY COUNTY COURT FEES FOR
6565 COURT FACILITIES: GOVERNMENT CODE. The clerk of a statutory county
6666 court in Rockwall County shall collect an additional filing fee of
6767 not more than $15 under Section 51.709 in civil cases to fund the
6868 construction, renovation, or improvement of court facilities, if
6969 authorized by the county commissioners court.
7070 SECTION 4. Subchapter F, Chapter 101, Government Code, is
7171 amended by adding Section 101.10118 to read as follows:
7272 Sec. 101.10118. ADDITIONAL STATUTORY PROBATE COURT FEES FOR
7373 COURT FACILITIES: GOVERNMENT CODE. The clerk of a statutory
7474 probate court in Rockwall County shall collect an additional filing
7575 fee of not more than $15 under Section 51.709 in civil cases to fund
7676 the construction, renovation, or improvement of court facilities,
7777 if authorized by the county commissioners court.
7878 SECTION 5. Subchapter H, Chapter 101, Government Code, is
7979 amended by adding Section 101.142 to read as follows:
8080 Sec. 101.142. ADDITIONAL JUSTICE COURT FEE FOR COURT
8181 FACILITIES COLLECTED BY CLERK. The clerk of a justice court in
8282 Rockwall County shall collect an additional filing fee of not more
8383 than $15 under Section 51.709 in civil cases to fund the
8484 construction, renovation, or improvement of court facilities, if
8585 authorized by the county commissioners court.
8686 SECTION 6. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2013.
