9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 38.001, Insurance Code, is amended by | |
11 | 11 | amending Subsection (c) and adding Subsection (e) to read as | |
12 | 12 | follows: | |
13 | 13 | (c) A person receiving an inquiry under Subsection (b) shall | |
14 | 14 | respond to the inquiry in writing not later than the 15th [10th] day | |
15 | 15 | after the date the inquiry is received. If the department receives | |
16 | 16 | written notice from the person that additional time is required to | |
17 | 17 | respond to the inquiry, the department shall grant a 10-day | |
18 | 18 | extension of the time to respond to the inquiry. | |
19 | 19 | (e) The department shall maintain a record of all inquiries | |
20 | 20 | made by the department under this section. | |
21 | 21 | SECTION 2. The changes in law made by this Act apply only to | |
22 | 22 | an inquiry made by the Texas Department of Insurance on or after the | |
23 | 23 | effective date of this Act. An inquiry made before the effective | |
24 | 24 | date of this Act is governed by the law in effect immediately before | |
25 | 25 | the effective date of this Act, and that law is continued in effect | |
26 | 26 | for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2013. |
