77 relating to certain inquiries made by the Texas Department of
88 Insurance to insurers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.001, Insurance Code, is amended by
1111 amending Subsection (c) and adding Subsection (e) to read as
1212 follows:
1313 (c) A person receiving an inquiry under Subsection (b) shall
1414 respond to the inquiry in writing not later than the 15th [10th] day
1515 after the date the inquiry is received. If the department receives
1616 written notice from the person that additional time is required to
1717 respond to the inquiry, the department shall grant a 10-day
1818 extension of the time to respond to the inquiry.
1919 (e) The department shall maintain a record of all inquiries
2020 made by the department under this section.
2121 SECTION 2. The changes in law made by this Act apply only to
2222 an inquiry made by the Texas Department of Insurance on or after the
2323 effective date of this Act. An inquiry made before the effective
2424 date of this Act is governed by the law in effect immediately before
2525 the effective date of this Act, and that law is continued in effect
2626 for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2013.
