7 | 7 | | relating to the power and duties of the Fulshear Municipal Utility |

8 | 8 | | District No. 1 of Fort Bend County. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsection (a), Section 8207.102, Special |
---|
11 | 11 | | District Local Laws Code, is amended to read as follows: |
---|
12 | 12 | | (a) To the extent authorized by Section 52, Article III, |
---|
13 | 13 | | Texas Constitution, the district may construct, acquire, improve, |
---|
14 | 14 | | maintain, or operate macadamized, graveled, or paved roads or |
---|
15 | 15 | | turnpikes, or improvements in aid of those roads or turnpikes[, |
---|
16 | 16 | | inside the district]. |
---|
17 | 17 | | SECTION 2. Fulshear Municipal Utility District No. 1 of |
---|
18 | 18 | | Fort Bend County retains all the rights, powers, privileges, |
---|
19 | 19 | | authority, duties, and functions that it had before the effective |
---|
20 | 20 | | date of this Act. |
---|
21 | 21 | | SECTION 3. (a) The legislature validates and confirms all |
---|
22 | 22 | | governmental acts and proceedings of Fulshear Municipal Utility |
---|
23 | 23 | | District No. 1 of Fort Bend County that were taken before the |
---|
24 | 24 | | effective date of this Act. |
---|
25 | 25 | | (b) This section does not apply to any matter that on the |
---|
26 | 26 | | effective date of this Act: |
---|
27 | 27 | | (1) is involved in litigation if the litigation |
---|
28 | 28 | | ultimately results in the matter being held invalid by a final court |
---|
29 | 29 | | judgment; or |
---|
30 | 30 | | (2) has been held invalid by a final court judgment. |
---|
31 | 31 | | SECTION 4. (a) The legal notice of the intention to |
---|
32 | 32 | | introduce this Act, setting forth the general substance of this |
---|
33 | 33 | | Act, has been published as provided by law, and the notice and a |
---|
34 | 34 | | copy of this Act have been furnished to all persons, agencies, |
---|
35 | 35 | | officials, or entities to which they are required to be furnished |
---|
36 | 36 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
37 | 37 | | Government Code. |
---|
38 | 38 | | (b) The governor, one of the required recipients, has |
---|
39 | 39 | | submitted the notice and Act to the Texas Commission on |
---|
40 | 40 | | Environmental Quality. |
---|
41 | 41 | | (c) The Texas Commission on Environmental Quality has filed |
---|
42 | 42 | | its recommendations relating to this Act with the governor, the |
---|
43 | 43 | | lieutenant governor, and the speaker of the house of |
---|
44 | 44 | | representatives within the required time. |
---|
45 | 45 | | (d) All requirements of the constitution and laws of this |
---|
46 | 46 | | state and the rules and procedures of the legislature with respect |
---|
47 | 47 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
48 | 48 | | and accomplished. |
---|
49 | 49 | | SECTION 5. This Act takes effect immediately if it receives |
---|
50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
---|
51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
---|
53 | 53 | | Act takes effect September 1, 2013. |
