66 AN ACT
77 relating to the power and duties of the Fulshear Municipal Utility
88 District No. 1 of Fort Bend County.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Section 8207.102, Special
1111 District Local Laws Code, is amended to read as follows:
1212 (a) To the extent authorized by Section 52, Article III,
1313 Texas Constitution, the district may construct, acquire, improve,
1414 maintain, or operate macadamized, graveled, or paved roads or
1515 turnpikes, or improvements in aid of those roads or turnpikes[,
1616 inside the district].
1717 SECTION 2. Fulshear Municipal Utility District No. 1 of
1818 Fort Bend County retains all the rights, powers, privileges,
1919 authority, duties, and functions that it had before the effective
2020 date of this Act.
2121 SECTION 3. (a) The legislature validates and confirms all
2222 governmental acts and proceedings of Fulshear Municipal Utility
2323 District No. 1 of Fort Bend County that were taken before the
2424 effective date of this Act.
2525 (b) This section does not apply to any matter that on the
2626 effective date of this Act:
2727 (1) is involved in litigation if the litigation
2828 ultimately results in the matter being held invalid by a final court
2929 judgment; or
3030 (2) has been held invalid by a final court judgment.
3131 SECTION 4. (a) The legal notice of the intention to
3232 introduce this Act, setting forth the general substance of this
3333 Act, has been published as provided by law, and the notice and a
3434 copy of this Act have been furnished to all persons, agencies,
3535 officials, or entities to which they are required to be furnished
3636 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3737 Government Code.
3838 (b) The governor, one of the required recipients, has
3939 submitted the notice and Act to the Texas Commission on
4040 Environmental Quality.
4141 (c) The Texas Commission on Environmental Quality has filed
4242 its recommendations relating to this Act with the governor, the
4343 lieutenant governor, and the speaker of the house of
4444 representatives within the required time.
4545 (d) All requirements of the constitution and laws of this
4646 state and the rules and procedures of the legislature with respect
4747 to the notice, introduction, and passage of this Act are fulfilled
4848 and accomplished.
4949 SECTION 5. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2013.
