77 relating to the funding of the Texas Home Visiting Program;
88 authorizing voluntary contributions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 2.004, Family Code, is
1111 amended to read as follows:
1212 (b) The application form must contain:
1313 (1) a heading entitled "Application for Marriage
1414 License, ____________ County, Texas";
1515 (2) spaces for each applicant's full name, including
1616 the woman's maiden surname, address, social security number, if
1717 any, date of birth, and place of birth, including city, county, and
1818 state;
1919 (3) a space for indicating the document tendered by
2020 each applicant as proof of identity and age;
2121 (4) spaces for indicating whether each applicant has
2222 been divorced within the last 30 days;
2323 (5) printed boxes for each applicant to check "true"
2424 or "false" in response to the following statement: "I am not
2525 presently married and the other applicant is not presently
2626 married.";
2727 (6) printed boxes for each applicant to check "true"
2828 or "false" in response to the following statement: "The other
2929 applicant is not related to me as:
3030 (A) an ancestor or descendant, by blood or
3131 adoption;
3232 (B) a brother or sister, of the whole or half
3333 blood or by adoption;
3434 (C) a parent's brother or sister, of the whole or
3535 half blood or by adoption;
3636 (D) a son or daughter of a brother or sister, of
3737 the whole or half blood or by adoption;
3838 (E) a current or former stepchild or stepparent;
3939 or
4040 (F) a son or daughter of a parent's brother or
4141 sister, of the whole or half blood or by adoption.";
4242 (7) printed boxes for each applicant to check "true"
4343 or "false" in response to the following statement: "I am not
4444 presently delinquent in the payment of court-ordered child
4545 support.";
4646 (8) a printed oath reading: "I SOLEMNLY SWEAR (OR
4747 AFFIRM) THAT THE INFORMATION I HAVE GIVEN IN THIS APPLICATION IS
4848 CORRECT.";
4949 (9) spaces immediately below the printed oath for the
5050 applicants' signatures;
5151 (10) a certificate of the county clerk that:
5252 (A) each applicant made the oath and the date and
5353 place that it was made; or
5454 (B) an applicant did not appear personally but
5555 the prerequisites for the license have been fulfilled as provided
5656 by this chapter;
5757 (11) spaces for indicating the date of the marriage
5858 and the county in which the marriage is performed; [and]
5959 (12) a space for the address to which the applicants
6060 desire the completed license to be mailed; and
6161 (13) a printed box for each applicant to check
6262 indicating that the applicant wishes to make a voluntary
6363 contribution of $5 to promote healthy early childhood by supporting
6464 the Texas Home Visiting Program administered by the Office of Early
6565 Childhood Coordination of the Health and Human Services Commission.
6666 SECTION 2. Subchapter H, Chapter 531, Government Code, is
6767 amended by adding Section 531.287 to read as follows:
6868 Sec. 531.287. TEXAS HOME VISITING PROGRAM TRUST FUND.
6969 (a) The Texas Home Visiting Program trust fund is created as a
7070 trust fund outside the treasury with the comptroller and shall be
7171 administered by the office under this section and rules adopted by
7272 the executive commissioner. Credits of money in the fund are not
7373 state funds or subject to legislative appropriation.
7474 (b) The trust fund consists of money from voluntary
7575 contributions under Section 191.0048, Health and Safety Code, and
7676 Section 118.018, Local Government Code.
7777 (c) Money in the fund may be spent without appropriation by
7878 the office only for the purpose of the Texas Home Visiting Program
7979 administered by the commission.
8080 (d) Interest and income from the assets of the trust fund
8181 shall be credited to and deposited in the trust fund.
8282 SECTION 3. Subchapter A, Chapter 191, Health and Safety
8383 Code, is amended by adding Section 191.0048 to read as follows:
8484 Sec. 191.0048. VOLUNTARY CONTRIBUTION TO TEXAS HOME
8585 VISITING PROGRAM. (a) A person requesting a copy or certified
8686 copy of a birth, marriage, or divorce record may make a voluntary
8787 contribution of $5 to promote healthy early childhood by supporting
8888 the Texas Home Visiting Program administered by the Office of Early
8989 Childhood Coordination of the Health and Human Services Commission.
9090 (b) On each paper or electronic application form for a copy
9191 or certified copy of a birth, marriage, or divorce record, the
9292 bureau of vital statistics shall include a printed box for the
9393 applicant to check indicating that the applicant wishes to make a
9494 voluntary contribution of $5 to promote healthy early childhood by
9595 supporting the Texas Home Visiting Program administered by the
9696 Office of Early Childhood Coordination of the Health and Human
9797 Services Commission.
9898 (c) Notwithstanding Section 191.0045, a local registrar or
9999 county clerk may collect the additional voluntary contribution
100100 under this section.
101101 (d) Notwithstanding Section 191.005, the local registrar or
102102 county clerk who collects the voluntary contribution under this
103103 section shall send the voluntary contribution to the comptroller,
104104 who shall deposit the voluntary contribution in the Texas Home
105105 Visiting Program trust fund under Section 531.287, Government Code.
106106 SECTION 4. Section 118.018, Local Government Code, is
107107 amended by adding Subsection (c) to read as follows:
108108 (c) A person applying for a marriage license may make a
109109 voluntary contribution of $5 to promote healthy early childhood by
110110 supporting the Texas Home Visiting Program administered by the
111111 Office of Early Childhood Coordination of the Health and Human
112112 Services Commission. A county clerk shall collect the additional
113113 voluntary contribution under this section.
114114 SECTION 5. Section 118.022, Local Government Code, is
115115 amended by amending Subsection (a) and adding Subsection (d) to
116116 read as follows:
117117 (a) If the county clerk collects a fee for issuing a
118118 marriage license, the county clerk shall deposit, as provided by
119119 Subchapter B, Chapter 133:
120120 (1) $20 of each fee collected for issuing a marriage
121121 license or $12.50 of each fee for recording a declaration of
122122 informal marriage to be sent to the comptroller and deposited as
123123 provided by Subsection (b); [and]
124124 (2) $10 of each fee collected for issuing a marriage
125125 license to be sent to the comptroller and deposited as provided by
126126 Subsection (c); and
127127 (3) if applicable, the $5 voluntary contribution
128128 collected to promote healthy early childhood by supporting the
129129 Texas Home Visiting Program administered by the Office of Early
130130 Childhood Coordination of the Health and Human Services Commission
131131 to be sent to the comptroller and deposited as provided by
132132 Subsection (d).
133133 (d) The comptroller shall deposit the money received under
134134 Subsection (a)(3) in the Texas Home Visiting Program trust fund
135135 under Section 531.287, Government Code.
136136 SECTION 6. The change in law made by this Act applies only
137137 to a person who applies for a marriage license or requests a copy or
138138 certified copy of a birth, marriage, or divorce record on or after
139139 January 1, 2014.
140140 SECTION 7. This Act takes effect immediately if it receives
141141 a vote of two-thirds of all the members elected to each house, as
142142 provided by Section 39, Article III, Texas Constitution. If this
143143 Act does not receive the vote necessary for immediate effect, this
144144 Act takes effect September 1, 2013.
