99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 8434 to read as follows:
1212 CHAPTER 8434. COTTON CENTER MUNICIPAL UTILITY DISTRICT NO. 2 OF
1313 CALDWELL COUNTY
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8434.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Commission" means the Texas Commission on
1818 Environmental Quality.
1919 (3) "Director" means a board member.
2020 (4) "District" means the Cotton Center Municipal
2121 Utility District No. 2 of Caldwell County.
2222 Sec. 8434.002. NATURE OF DISTRICT. The district is a
2323 municipal utility district created under Section 59, Article XVI,
2424 Texas Constitution.
2525 Sec. 8434.003. CONFIRMATION AND DIRECTORS' ELECTION
2626 REQUIRED. The temporary directors shall hold an election to
2727 confirm the creation of the district and to elect five permanent
2828 directors as provided by Section 49.102, Water Code.
2929 Sec. 8434.004. CONSENT OF MUNICIPALITY REQUIRED. The
3030 temporary directors may not hold an election under Section 8434.003
3131 until each municipality in whose corporate limits or
3232 extraterritorial jurisdiction the district is located has
3333 consented by ordinance or resolution to the creation of the
3434 district and to the inclusion of land in the district.
3535 Sec. 8434.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3636 (a) The district is created to serve a public purpose and benefit.
3737 (b) The district is created to accomplish the purposes of:
3838 (1) a municipal utility district as provided by
3939 general law and Section 59, Article XVI, Texas Constitution; and
4040 (2) Section 52, Article III, Texas Constitution, that
4141 relate to the construction, acquisition, improvement, operation,
4242 or maintenance of macadamized, graveled, or paved roads, or
4343 improvements, including storm drainage, in aid of those roads.
4444 Sec. 8434.006. INITIAL DISTRICT TERRITORY. (a) The
4545 district is initially composed of the territory described by
4646 Section 2 of the Act enacting this chapter.
4747 (b) The boundaries and field notes contained in Section 2 of
4848 the Act enacting this chapter form a closure. A mistake made in the
4949 field notes or in copying the field notes in the legislative process
5050 does not affect the district's:
5151 (1) organization, existence, or validity;
5252 (2) right to issue any type of bond for the purposes
5353 for which the district is created or to pay the principal of and
5454 interest on a bond;
5555 (3) right to impose a tax; or
5656 (4) legality or operation.
5757 Sec. 8434.007. ELIGIBILITY FOR INCLUSION IN TAX INCREMENT
5858 REINVESTMENT ZONE. (a) The district is eligible to be included in
5959 a tax increment reinvestment zone created under Chapter 311, Tax
6060 Code.
6161 (b) If the City of Martindale creates a tax increment
6262 reinvestment zone described by Subsection (a) that includes all or
6363 part of the territory of the district, the City of Martindale and
6464 the board of directors of the zone, by contract with the district,
6565 may grant money to the district from the tax increment fund to be
6666 used for a permissible purpose of the district, including the right
6767 to pledge the money as security for a bond or other obligation
6868 issued by the district and for any permissible purpose of a
6969 corporation under Section 380.002(b), Local Government Code.
7070 SUBCHAPTER B. BOARD OF DIRECTORS
7171 Sec. 8434.051. GOVERNING BODY; TERMS. (a) The district is
7272 governed by a board of five elected directors.
7373 (b) Except as provided by Section 8434.052, directors serve
7474 staggered four-year terms.
7575 Sec. 8434.052. TEMPORARY DIRECTORS. (a) The temporary
7676 board consists of:
7777 (1) Brandon D. Rabe;
7878 (2) Garrod E. Huebner;
7979 (3) Brendan K. Puthoff;
8080 (4) Jeremy P. Poloskey; and
8181 (5) Brian J. Kaucher.
8282 (b) Temporary directors serve until the earlier of:
8383 (1) the date permanent directors are elected under
8484 Section 8434.003; or
8585 (2) the fourth anniversary of the effective date of
8686 the Act enacting this chapter.
8787 (c) If permanent directors have not been elected under
8888 Section 8434.003 and the terms of the temporary directors have
8989 expired, successor temporary directors shall be appointed or
9090 reappointed as provided by Subsection (d) to serve terms that
9191 expire on the earlier of:
9292 (1) the date permanent directors are elected under
9393 Section 8434.003; or
9494 (2) the fourth anniversary of the date of the
9595 appointment or reappointment.
9696 (d) If Subsection (c) applies, the owner or owners of a
9797 majority of the assessed value of the real property in the district
9898 may submit a petition to the commission requesting that the
9999 commission appoint as successor temporary directors the five
100100 persons named in the petition. The commission shall appoint as
101101 successor temporary directors the five persons named in the
102102 petition.
103103 SUBCHAPTER C. POWERS AND DUTIES
104104 Sec. 8434.101. GENERAL POWERS AND DUTIES. The district has
105105 the powers and duties necessary to accomplish the purposes for
106106 which the district is created.
107107 Sec. 8434.102. MUNICIPAL UTILITY DISTRICT POWERS AND
108108 DUTIES. The district has the powers and duties provided by the
109109 general law of this state, including Chapters 49 and 54, Water Code,
110110 applicable to municipal utility districts created under Section 59,
111111 Article XVI, Texas Constitution.
112112 Sec. 8434.103. AUTHORITY FOR ROAD PROJECTS. Under Section
113113 52, Article III, Texas Constitution, the district may design,
114114 acquire, construct, finance, issue bonds for, improve, operate,
115115 maintain, and convey to this state, a county, or a municipality for
116116 operation and maintenance macadamized, graveled, or paved roads, or
117117 improvements, including storm drainage, in aid of those roads.
118118 Sec. 8434.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
119119 road project must meet all applicable construction standards,
120120 zoning and subdivision requirements, and regulations of each
121121 municipality in whose corporate limits or extraterritorial
122122 jurisdiction the road project is located.
123123 (b) If a road project is not located in the corporate limits
124124 or extraterritorial jurisdiction of a municipality, the road
125125 project must meet all applicable construction standards,
126126 subdivision requirements, and regulations of each county in which
127127 the road project is located.
128128 (c) If the state will maintain and operate the road, the
129129 Texas Transportation Commission must approve the plans and
130130 specifications of the road project.
131131 Sec. 8434.105. COSTS OF ROAD PROJECT. The district may bear
132132 the cost of designing, maintaining, improving, and operating a road
133133 in the district authorized under Section 8434.103 in accordance
134134 with all applicable ordinances and rules of the political
135135 subdivision authorized to exercise jurisdiction over the road,
136136 regardless of whether the district conveys the road to this state, a
137137 county, or a municipality.
138138 Sec. 8434.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
139139 OR RESOLUTION. (a) The district shall comply with all applicable
140140 requirements of any ordinance or resolution that is adopted under
141141 Section 54.016 or 54.0165, Water Code, and that consents to the
142142 creation of the district or to the inclusion of land in the
143143 district.
144144 (b) In addition to all the rights and remedies provided by
145145 other law, if the district violates the terms of an ordinance or
146146 resolution described by Subsection (a), the municipality is
147147 entitled to injunctive relief or a writ of mandamus issued by a
148148 court requiring the district and the district's officials to
149149 observe and comply with the terms of the ordinance or resolution.
150150 Sec. 8434.107. MUNICIPAL CONSENT. Municipal consent to the
151151 creation of the district and to the inclusion of land in the
152152 district granted under Section 8434.004 acts as municipal consent
153153 to the creation of any new district created by the division of the
154154 district and to the inclusion of land in the new district.
155155 Sec. 8434.108. EFFECT OF ANNEXATION BY CITY OF MARTINDALE.
156156 Notwithstanding Section 54.016(f)(2), Water Code, an allocation
157157 agreement between the City of Martindale and the district that
158158 provides for the allocation of the taxes or revenues of the district
159159 and the city following the date of inclusion of all the district's
160160 territory in the corporate limits of the city may provide that the
161161 total annual ad valorem taxes collected by the city and the district
162162 from taxable property in the district may exceed the city's ad
163163 valorem tax on that property.
164164 SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS
165165 Sec. 8434.151. DIVISION OF DISTRICT; PREREQUISITES. The
166166 district may be divided into two or more new districts only if the
167167 district:
168168 (1) has never issued any bonds; and
169169 (2) is not imposing ad valorem taxes.
170170 Sec. 8434.152. LAW APPLICABLE TO NEW DISTRICT. This
171171 chapter applies to any new district created by division of the
172172 district, and a new district has all the powers and duties of the
173173 district.
174174 Sec. 8434.153. LIMITATION ON AREA OF NEW DISTRICT. A new
175175 district created by the division of the district may not, at the
176176 time the new district is created, contain any land outside the area
177177 described by Section 2 of the Act enacting this chapter.
178178 Sec. 8434.154. DIVISION PROCEDURES. (a) The board, on its
179179 own motion or on receipt of a petition signed by the owner or owners
180180 of a majority of the assessed value of the real property in the
181181 district, may adopt an order dividing the district.
182182 (b) The board may adopt an order dividing the district
183183 before or after the date the board holds an election under Section
184184 8434.003 to confirm the district's creation.
185185 (c) An order dividing the district must:
186186 (1) name each new district;
187187 (2) include the metes and bounds description of the
188188 territory of each new district;
189189 (3) appoint temporary directors for each new district;
190190 and
191191 (4) provide for the division of assets and liabilities
192192 between the new districts.
193193 (d) On or before the 30th day after the date of adoption of
194194 an order dividing the district, the district shall file the order
195195 with the commission and record the order in the real property
196196 records of each county in which the district is located.
197197 Sec. 8434.155. CONFIRMATION ELECTION FOR NEW DISTRICT.
198198 (a) A new district created by the division of the district shall
199199 hold a confirmation and directors' election as required by Section
200200 8434.003.
201201 (b) If the creation of the new district is confirmed, the
202202 new district shall provide the election date and results to the
203203 commission.
204204 Sec. 8434.156. TAX OR BOND ELECTION. Before a new district
205205 created by the division of the district may impose a maintenance tax
206206 or issue bonds payable wholly or partly from ad valorem taxes, the
207207 new district must hold an election as required by this chapter to
208208 obtain voter approval.
209209 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
210210 Sec. 8434.201. ELECTIONS REGARDING TAXES OR BONDS.
211211 (a) The district may issue, without an election, bonds and other
212212 obligations secured by:
213213 (1) revenue other than ad valorem taxes; or
214214 (2) contract payments described by Section 8434.203.
215215 (b) The district must hold an election in the manner
216216 provided by Chapters 49 and 54, Water Code, to obtain voter approval
217217 before the district may impose an ad valorem tax or issue bonds
218218 payable from ad valorem taxes.
219219 (c) The district may not issue bonds payable from ad valorem
220220 taxes to finance a road project unless the issuance is approved by a
221221 vote of a two-thirds majority of the district voters voting at an
222222 election held for that purpose.
223223 Sec. 8434.202. OPERATION AND MAINTENANCE TAX. (a) If
224224 authorized at an election held under Section 8434.201, the district
225225 may impose an operation and maintenance tax on taxable property in
226226 the district in accordance with Section 49.107, Water Code.
227227 (b) The board shall determine the tax rate. The rate may not
228228 exceed the rate approved at the election.
229229 Sec. 8434.203. CONTRACT TAXES. (a) In accordance with
230230 Section 49.108, Water Code, the district may impose a tax other than
231231 an operation and maintenance tax and use the revenue derived from
232232 the tax to make payments under a contract after the provisions of
233233 the contract have been approved by a majority of the district voters
234234 voting at an election held for that purpose.
235235 (b) A contract approved by the district voters may contain a
236236 provision stating that the contract may be modified or amended by
237237 the board without further voter approval.
238238 SUBCHAPTER F. BONDS AND OTHER OBLIGATIONS
239239 Sec. 8434.251. AUTHORITY TO ISSUE BONDS AND OTHER
240240 OBLIGATIONS. The district may issue bonds or other obligations
241241 payable wholly or partly from ad valorem taxes, impact fees,
242242 revenue, contract payments, grants, or other district money, or any
243243 combination of those sources, to pay for any authorized district
244244 purpose.
245245 Sec. 8434.252. TAXES FOR BONDS. At the time the district
246246 issues bonds payable wholly or partly from ad valorem taxes, the
247247 board shall provide for the annual imposition of a continuing
248248 direct ad valorem tax, without limit as to rate or amount, while all
249249 or part of the bonds are outstanding as required and in the manner
250250 provided by Sections 54.601 and 54.602, Water Code.
251251 Sec. 8434.253. BONDS FOR ROAD PROJECTS. At the time of
252252 issuance, the total principal amount of bonds or other obligations
253253 issued or incurred to finance road projects and payable from ad
254254 valorem taxes may not exceed one-fourth of the assessed value of the
255255 real property in the district.
256256 SECTION 2. The Cotton Center Municipal Utility District
257257 No. 2 of Caldwell County initially includes all the territory
258258 contained in the following area:

874874 feet to the POINT OF BEGINNING, and containing an area of 37.8 acres
875875 of land, more or less, within these metes and bounds.
876876 SECTION 3. (a) The legal notice of the intention to
877877 introduce this Act, setting forth the general substance of this
878878 Act, has been published as provided by law, and the notice and a
879879 copy of this Act have been furnished to all persons, agencies,
880880 officials, or entities to which they are required to be furnished
881881 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
882882 Government Code.
883883 (b) The governor, one of the required recipients, has
884884 submitted the notice and Act to the Texas Commission on
885885 Environmental Quality.
886886 (c) The Texas Commission on Environmental Quality has filed
887887 its recommendations relating to this Act with the governor, the
888888 lieutenant governor, and the speaker of the house of
889889 representatives within the required time.
890890 (d) All requirements of the constitution and laws of this
891891 state and the rules and procedures of the legislature with respect
892892 to the notice, introduction, and passage of this Act are fulfilled
893893 and accomplished.
894894 SECTION 4. (a) If this Act does not receive a two-thirds
895895 vote of all the members elected to each house, Subchapter C, Chapter
896896 8434, Special District Local Laws Code, as added by Section 1 of
897897 this Act, is amended by adding Section 8434.109 to read as follows:
898898 Sec. 8434.109. NO EMINENT DOMAIN POWER. The district may
899899 not exercise the power of eminent domain.
900900 (b) This section is not intended to be an expression of a
901901 legislative interpretation of the requirements of Subsection (c),
902902 Section 17, Article I, Texas Constitution.
903903 SECTION 5. This Act takes effect immediately if it receives
904904 a vote of two-thirds of all the members elected to each house, as
905905 provided by Section 39, Article III, Texas Constitution. If this
906906 Act does not receive the vote necessary for immediate effect, this
907907 Act takes effect September 1, 2013.
