99 AN ACT
1010 relating to the Corn Hill Regional Water Authority.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsection (c), Section 8364.004, Special
1313 District Local Laws Code, is amended to read as follows:
1414 (c) The authority is created to accomplish:
1515 (1) the control, storage, conservation, preservation,
1616 distribution, and use of water for domestic, industrial, municipal,
1717 and all other useful purposes as provided by Section 59, Article
1818 XVI, Texas Constitution;
1919 (2) the reclamation and drainage of the district's
2020 overflowed lands and other lands needing drainage;
2121 (3) the control, abatement, and change of any shortage
2222 or harmful excess of water; and
2323 (4) the protection, preservation, and restoration of
2424 the purity and sanitary condition of water within the state.
2525 SECTION 2. Subchapter B, Chapter 8364, Special District
2626 Local Laws Code, is amended by adding Section 8364.052 to read as
2727 follows:
2828 Sec. 8364.052. EX OFFICIO DIRECTORS. (a) At any time, the
2929 board may by resolution:
3030 (1) appoint a nonvoting ex officio director to serve
3131 at the pleasure of the board; and
3232 (2) remove an ex officio director.
3333 (b) An ex officio director:
3434 (1) is entitled to all notices and information given
3535 to and accessible to a director; and
3636 (2) may attend and participate in any board meeting.
3737 SECTION 3. Subsection (a), Section 8364.072, Special
3838 District Local Laws Code, is amended to read as follows:
3939 (a) A municipality, county, or other political subdivision
4040 may petition the board to add that municipality, county, or other
4141 political subdivision as a member entity.
4242 SECTION 4. Section 8364.103, Special District Local Laws
4343 Code, is amended to read as follows:
4444 Sec. 8364.103. MUNICIPAL UTILITY DISTRICT POWERS AND
4545 DUTIES; LIMITATIONS. (a) Except as provided by Subsection
4646 [Subsections] (b) [and (c)], the authority has the powers and
4747 duties provided by the general law of this state, including
4848 Chapters 49 and 54, Water Code, applicable to municipal utility
4949 districts created under Section 59, Article XVI, Texas
5050 Constitution.
5151 (b) The authority may not provide [wastewater, drainage,]
5252 solid waste disposal[,] or road facilities or services.
5353 [(c) The authority does not have any power that the member
5454 entities do not have.]
5555 SECTION 5. Subsection (a), Section 8364.151, Special
5656 District Local Laws Code, is amended to read as follows:
5757 (a) For any authorized authority purpose, the authority may
5858 issue bonds or other obligations payable wholly or partly from
5959 revenue of the authority's water system, sanitary sewer system, or
6060 drainage system, including revenue from contracts with member
6161 entities or customers, or any combination of those sources of
6262 revenue.
6363 SECTION 6. Subchapter D, Chapter 8364, Special District
6464 Local Laws Code, is amended by adding Section 8364.153 to read as
6565 follows:
6666 Sec. 8364.153. FUNDING BY MEMBERS. Under a contract with
6767 the authority, a member entity may make payments from any of the
6868 member entity's sources of revenue, including ad valorem taxes,
6969 impact fees, grants, sales and use taxes, and any other source to
7070 provide money for the administrative and operating expenses of the
7171 authority.
7272 SECTION 7. (a) The legal notice of the intention to
7373 introduce this Act, setting forth the general substance of this
7474 Act, has been published as provided by law, and the notice and a
7575 copy of this Act have been furnished to all persons, agencies,
7676 officials, or entities to which they are required to be furnished
7777 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
7878 Government Code.
7979 (b) The governor, one of the required recipients, has
8080 submitted the notice and Act to the Texas Commission on
8181 Environmental Quality.
8282 (c) The Texas Commission on Environmental Quality has filed
8383 its recommendations relating to this Act with the governor, the
8484 lieutenant governor, and the speaker of the house of
8585 representatives within the required time.
8686 (d) All requirements of the constitution and laws of this
8787 state and the rules and procedures of the legislature with respect
8888 to the notice, introduction, and passage of this Act are fulfilled
8989 and accomplished.
9090 SECTION 8. This Act takes effect immediately if it receives
9191 a vote of two-thirds of all the members elected to each house, as
9292 provided by Section 39, Article III, Texas Constitution. If this
9393 Act does not receive the vote necessary for immediate effect, this
9494 Act takes effect September 1, 2013.
