88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 9043 to read as follows:
1111 CHAPTER 9043. COLLIN COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT

1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 9043.001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the district's board of directors.
1616 (2) "District" means the Collin County Water Control
1717 and Improvement District No. 3.
1818 Sec. 9043.002. NATURE AND PURPOSES OF DISTRICT. (a) The
1919 district is a water control and improvement district created under
2020 Section 59, Article XVI, Texas Constitution.
2121 (b) The district is created to accomplish the purposes of:
2222 (1) a water control and improvement district as
2323 provided by general law and Section 59, Article XVI, Texas
2424 Constitution; and
2525 (2) Section 52, Article III, Texas Constitution, that
2626 relate to the construction, acquisition, improvement, operation,
2727 or maintenance of macadamized, graveled, or paved roads, or
2828 improvements, including storm drainage, in aid of those roads.
2929 SUBCHAPTER B. POWERS AND DUTIES
3030 Sec. 9043.051. GENERAL POWERS AND DUTIES. The district has
3131 the powers and duties necessary to accomplish the purposes for
3232 which the district is created.
3333 Sec. 9043.052. WATER CONTROL AND IMPROVEMENT DISTRICT
3434 POWERS AND DUTIES. The district has the powers and duties provided
3535 by the general law of this state, including Chapters 49 and 51,
3636 Water Code, applicable to water control and improvement districts
3737 created under Section 59, Article XVI, Texas Constitution.
3838 Sec. 9043.053. AUTHORITY FOR ROAD PROJECTS. Under Section
3939 52, Article III, Texas Constitution, the district may design,
4040 acquire, construct, finance, issue bonds for, improve, operate,
4141 maintain, and convey to this state, a county, or a municipality for
4242 operation and maintenance macadamized, graveled, or paved roads, or
4343 improvements, including storm drainage, in aid of those roads.
4444 Sec. 9043.054. ROAD STANDARDS AND REQUIREMENTS. (a) A
4545 road project must meet all applicable construction standards,
4646 zoning and subdivision requirements, and regulations of each
4747 municipality in whose corporate limits or extraterritorial
4848 jurisdiction the road project is located.
4949 (b) If a road project is not located in the corporate limits
5050 or extraterritorial jurisdiction of a municipality, the road
5151 project must meet all applicable construction standards,
5252 subdivision requirements, and regulations of each county in which
5353 the road project is located.
5454 (c) If the state will maintain and operate the road, the
5555 Texas Transportation Commission must approve the plans and
5656 specifications of the road project.
5757 SUBCHAPTER C. BONDS AND OTHER OBLIGATIONS
5858 Sec. 9043.101. AUTHORITY TO ISSUE BONDS AND OTHER
5959 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds
6060 or other obligations payable wholly or partly from ad valorem
6161 taxes, impact fees, revenue, contract payments, grants, or other
6262 district money, or any combination of those sources, to pay for a
6363 road project authorized by Section 9043.053.
6464 (b) The district may not issue bonds payable from ad valorem
6565 taxes to finance a road project unless the issuance is approved by a
6666 vote of a two-thirds majority of the district voters voting at an
6767 election held for that purpose.
6868 (c) At the time of issuance, the total principal amount of
6969 bonds or other obligations issued or incurred to finance road
7070 projects and payable from ad valorem taxes may not exceed
7171 one-fourth of the assessed value of real property in the district.
7272 Sec. 9043.102. TAXES FOR BONDS. At the time the district
7373 issues bonds payable wholly or partly from ad valorem taxes, the
7474 board shall provide for the annual imposition of a continuing
7575 direct ad valorem tax, without limit as to rate or amount, while all
7676 or part of the bonds are outstanding.
7777 SECTION 2. The Collin County Water Control and Improvement
7878 District No. 3 retains all the rights, powers, privileges,
7979 authority, duties, and functions that it had before the effective
8080 date of this Act.
8181 SECTION 3. (a) The legal notice of the intention to
8282 introduce this Act, setting forth the general substance of this
8383 Act, has been published as provided by law, and the notice and a
8484 copy of this Act have been furnished to all persons, agencies,
8585 officials, or entities to which they are required to be furnished
8686 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
8787 Government Code.
8888 (b) The governor, one of the required recipients, has
8989 submitted the notice and Act to the Texas Commission on
9090 Environmental Quality.
9191 (c) The Texas Commission on Environmental Quality has filed
9292 its recommendations relating to this Act with the governor, the
9393 lieutenant governor, and the speaker of the house of
9494 representatives within the required time.
9595 (d) All requirements of the constitution and laws of this
9696 state and the rules and procedures of the legislature with respect
9797 to the notice, introduction, and passage of this Act are fulfilled
9898 and accomplished.
9999 SECTION 4. This Act takes effect immediately if it receives
100100 a vote of two-thirds of all the members elected to each house, as
101101 provided by Section 39, Article III, Texas Constitution. If this
102102 Act does not receive the vote necessary for immediate effect, this
103103 Act takes effect September 1, 2013.
