77 relating to use of district funds by the Nueces County Hospital
88 District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 281.094, Health and Safety Code, is
1111 amended by amending Subsection (b) and adding Subsection (c) to
1212 read as follows:
1313 (b) The board of the Nueces County Hospital District may use
1414 funds made available to the district from any source to fund:
1515 (1) indigent health care; and
1616 (2) intergovernmental transfers from the district to
1717 the state for use as the nonfederal share of Medicaid supplemental
1818 payment program or waiver program payments for eligible health care
1919 providers located inside or outside the district's boundaries,
2020 including, but not limited to, any payments available through a
2121 waiver granted under Section 1115, Social Security Act (42 U.S.C.
2222 Section 1315), or other similar payment programs, subject to the
2323 limitation prescribed by Subsection (c).
2424 (c) Neither the funds comprising an intergovernmental
2525 transfer described by Subsection (b)(2) nor any federal funds
2626 obtained from any such transfer may be used by the board of the
2727 Nueces County Hospital District or any entity to expand eligibility
2828 for medical assistance (Medicaid) under the Patient Protection and
2929 Affordable Care Act (Pub. L. No. 111-148), as amended by the Health
3030 Care and Education Reconciliation Act of 2010 (Pub. L. No.
3131 111-152).
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2013.
