| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 281.094, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by amending Subsection (b) and adding Subsection (c) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (b) The board of the Nueces County Hospital District may use |
|---|
| 14 | 14 | | funds made available to the district from any source to fund: |
|---|
| 15 | 15 | | (1) indigent health care; and |
|---|
| 16 | 16 | | (2) intergovernmental transfers from the district to |
|---|
| 17 | 17 | | the state for use as the nonfederal share of Medicaid supplemental |
|---|
| 18 | 18 | | payment program or waiver program payments for eligible health care |
|---|
| 19 | 19 | | providers located inside or outside the district's boundaries, |
|---|
| 20 | 20 | | including, but not limited to, any payments available through a |
|---|
| 21 | 21 | | waiver granted under Section 1115, Social Security Act (42 U.S.C. |
|---|
| 22 | 22 | | Section 1315), or other similar payment programs, subject to the |
|---|
| 23 | 23 | | limitation prescribed by Subsection (c). |
|---|
| 24 | 24 | | (c) Neither the funds comprising an intergovernmental |
|---|
| 25 | 25 | | transfer described by Subsection (b)(2) nor any federal funds |
|---|
| 26 | 26 | | obtained from any such transfer may be used by the board of the |
|---|
| 27 | 27 | | Nueces County Hospital District or any entity to expand eligibility |
|---|
| 28 | 28 | | for medical assistance (Medicaid) under the Patient Protection and |
|---|
| 29 | 29 | | Affordable Care Act (Pub. L. No. 111-148), as amended by the Health |
|---|
| 30 | 30 | | Care and Education Reconciliation Act of 2010 (Pub. L. No. |
|---|
| 31 | 31 | | 111-152). |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2013. |
