10	10	relating to the boundaries of the East Montgomery County Municipal
11	11	Utility Districts Nos. 6 and 7.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 2, Chapter 775 (H.B. No. 3546), Acts of
14	14	the 79th Legislature, Regular Session, 2005, is amended to read as
15	15	follows:
16	16	Sec. 2. (a) The [Each district initially includes,
17	17	respectively, the territory contained in the following areas as
18	18	indicated:
19	19	[(1)] East Montgomery County Municipal Utility
20	20	District No. 5 initially includes the territory in the following
21	21	described areas:
22	22	PARCEL ONE
23	23	BEGINNING at the northeast corner of the herein described
24	24	tract, being a point in the westerly right-of-way of U.S. Highway 59
25	25	(width varies) as described in a deed dated May 14, 1965 from
26	26	William Marsh Rice University to the State of Texas as recorded in
27	27	Volume 597, Page 183 of the Montgomery County Deed Records (MCDR)

970	970	SECTION 2. The East Montgomery County Municipal Utility
971	971	Districts Nos. 6 and 7 retain all rights, powers, privileges,
972	972	authority, duties, and functions that they had before the effective
973	973	date of this Act. Notwithstanding any other law, the East
974	974	Montgomery County Municipal Utility Districts Nos. 6 and 7 may
975	975	continue to rely on any bond election held before the effective date
976	976	of this Act.
977	977	SECTION 3. (a) The legislature validates and confirms all
978	978	governmental acts and proceedings, including an election, of the
979	979	East Montgomery County Municipal Utility Districts Nos. 6 and 7
980	980	that were taken before the effective date of this Act.
981	981	(b) This section does not apply to:
982	982	(1) an act, proceeding, director, other official,
983	983	bond, or other obligation the validity of which or of whom is the
984	984	subject of litigation that is pending on the effective date of this
985	985	Act; or
986	986	(2) an act or proceeding that, under a statute of this
987	987	state or the United States, was a misdemeanor or felony at the time
988	988	the act or proceeding occurred.
989	989	SECTION 4. The amendments made by this Act to Section 2,
990	990	Chapter 775 (H.B. No. 3546), Acts of the 79th Legislature, Regular
991	991	Session, 2005, do not alter or otherwise affect the boundaries of
992	992	the district territory of the East Montgomery County Municipal
993	993	Utility District No. 5.
994	994	SECTION 5. (a) The legal notice of the intention to
995	995	introduce this Act, setting forth the general substance of this
996	996	Act, has been published as provided by law, and the notice and a
997	997	copy of this Act have been furnished to all persons, agencies,
998	998	officials, or entities to which they are required to be furnished
999	999	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
1000	1000	Government Code.
1001	1001	(b) The governor, one of the required recipients, has
1002	1002	submitted the notice and Act to the Texas Commission on
1003	1003	Environmental Quality.
1004	1004	(c) The Texas Commission on Environmental Quality has filed
1005	1005	its recommendations relating to this Act with the governor, the
1006	1006	lieutenant governor, and the speaker of the house of
1007	1007	representatives within the required time.
1008	1008	(d) All requirements of the constitution and laws of this
1009	1009	state and the rules and procedures of the legislature with respect
1010	1010	to the notice, introduction, and passage of this Act are fulfilled
1011	1011	and accomplished.
1012	1012	SECTION 6. This Act takes effect September 1, 2013.
