77 relating to the creation of the Cascades Municipal Utility District
88 No. 1; providing authority to issue bonds; providing authority to
99 impose assessments, fees, or taxes.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8477 to read as follows:
1313 CHAPTER 8477. CASCADES MUNICIPAL UTILITY DISTRICT NO. 1
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8477.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Commission" means the Texas Commission on
1818 Environmental Quality.
1919 (3) "Director" means a board member.
2020 (4) "District" means the Cascades Municipal Utility
2121 District No. 1.
2222 Sec. 8477.002. NATURE OF DISTRICT. The district is a
2323 municipal utility district created under Section 59, Article XVI,
2424 Texas Constitution.
2525 Sec. 8477.003. CONFIRMATION AND DIRECTORS' ELECTION
2626 REQUIRED. The temporary directors shall hold an election to
2727 confirm the creation of the district and to elect permanent
2828 directors as provided by Section 49.102, Water Code, and this
2929 chapter.
3030 Sec. 8477.004. CONSENT OF MUNICIPALITY REQUIRED. (a) The
3131 temporary directors may not hold an election under Section 8477.003
3232 until each municipality in whose corporate limits or
3333 extraterritorial jurisdiction the district is located has
3434 consented by ordinance or resolution to the creation of the
3535 district and to the inclusion of land in the district.
3636 (b) If a municipality in whose extraterritorial
3737 jurisdiction the district is located does not consent to the
3838 creation of the district or if the district does not enter into an
3939 agreement required by the terms of the municipal ordinance or
4040 resolution consenting to the creation of the district under this
4141 section before September 1, 2014:
4242 (1) the district is dissolved September 1, 2014,
4343 except that:
4444 (A) any debts incurred shall be paid;
4545 (B) any assets that remain after the payment of
4646 debts shall be transferred to the municipality or another local
4747 governmental entity to be used for a public purpose; and
4848 (C) the organization of the district shall be
4949 maintained until all debts are paid and remaining assets are
5050 transferred; and
5151 (2) this chapter expires September 1, 2014.
5252 Sec. 8477.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
5353 (a) The district is created to serve a public purpose and benefit.
5454 (b) The district is created to accomplish the purposes of:
5555 (1) a municipal utility district as provided by
5656 general law and Section 59, Article XVI, Texas Constitution; and
5757 (2) Section 52, Article III, Texas Constitution, that
5858 relate to the construction, acquisition, improvement, operation,
5959 or maintenance of macadamized, graveled, or paved roads, or
6060 improvements, including storm drainage, in aid of those roads.
6161 Sec. 8477.006. INITIAL DISTRICT TERRITORY. (a) The
6262 district is initially composed of the territory described by
6363 Section 2 of the Act enacting this chapter.
6464 (b) The boundaries and field notes contained in Section 2 of
6565 the Act enacting this chapter form a closure. A mistake made in the
6666 field notes or in copying the field notes in the legislative process
6767 does not affect the district's:
6868 (1) organization, existence, or validity;
6969 (2) right to issue any type of bond for the purposes
7070 for which the district is created or to pay the principal of and
7171 interest on a bond;
7272 (3) right to impose a tax; or
7373 (4) legality or operation.
7474 SUBCHAPTER B. BOARD OF DIRECTORS
7575 Sec. 8477.051. GOVERNING BODY; TERMS. (a) Except as
7676 provided by Subsection (b), the district is governed by a board of
7777 elected directors qualified to serve under Section 54.102, Water
7878 Code.
7979 (b) If required under the terms of the agreement, ordinance,
8080 or resolution by which a municipality consents to the creation of
8181 the district, the board consists of:
8282 (1) four elected directors qualified to serve under
8383 Section 54.102, Water Code; and
8484 (2) one director appointed by the governing body of
8585 the municipality who:
8686 (A) may be a member or other officer of the
8787 governing body or an employee of the municipality; and
8888 (B) is not required to be a qualified voter of the
8989 district or own land subject to taxation in the district.
9090 (c) The common law doctrine of incompatibility does not
9191 disqualify a member or other officer of the governing body or
9292 employee of the municipality from being appointed a director by the
9393 governing body of a municipality under Subsection (b)(2), and a
9494 director appointed to the board may continue to serve in a public
9595 office of or be employed by the municipality.
9696 (d) Except as provided by Section 8477.052, directors serve
9797 staggered four-year terms. A permanent director may not serve more
9898 than two four-year terms.
9999 Sec. 8477.052. TEMPORARY DIRECTORS. (a) The temporary
100100 board consists of:
101101 (1) John R. C. Munn;
102102 (2) George Roman;
103103 (3) Allen Gallia;
104104 (4) Donna Morgan; and
105105 (5) Charlotte Vick.
106106 (b) Temporary directors serve until the earlier of:
107107 (1) the date permanent directors are elected under
108108 Section 8477.003; or
109109 (2) the fourth anniversary of the effective date of
110110 the Act enacting this chapter.
111111 (c) If permanent directors have not been elected under
112112 Section 8477.003 and the terms of the temporary directors have
113113 expired, successor temporary directors shall be appointed or
114114 reappointed as provided by Subsection (d) to serve terms that
115115 expire on the earlier of:
116116 (1) the date permanent directors are elected under
117117 Section 8477.003; or
118118 (2) the fourth anniversary of the date of the
119119 appointment or reappointment.
120120 (d) If Subsection (c) applies, the owner or owners of a
121121 majority of the assessed value of the real property in the district
122122 may submit a petition to the commission requesting that the
123123 commission appoint as successor temporary directors the five
124124 persons named in the petition. The commission shall appoint as
125125 successor temporary directors the five persons named in the
126126 petition.
127127 SUBCHAPTER C. POWERS AND DUTIES
128128 Sec. 8477.101. GENERAL POWERS AND DUTIES. The district has
129129 the powers and duties necessary to accomplish the purposes for
130130 which the district is created.
131131 Sec. 8477.102. MUNICIPAL UTILITY DISTRICT POWERS AND
132132 DUTIES. The district has the powers and duties provided by the
133133 general law of this state, including Chapters 49 and 54, Water Code,
134134 applicable to municipal utility districts created under Section 59,
135135 Article XVI, Texas Constitution.
136136 Sec. 8477.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
137137 Section 52, Article III, Texas Constitution, the district may
138138 design, acquire, construct, finance, issue bonds for, improve, and
139139 convey to this state, a county, or a municipality for operation and
140140 maintenance macadamized, graveled, or paved roads described by
141141 Section 54.234, Water Code, or improvements, including storm
142142 drainage, in aid of those roads.
143143 (b) The district may exercise the powers provided by this
144144 section without submitting a petition to or obtaining approval from
145145 the commission as required by Section 54.234, Water Code.
146146 Sec. 8477.104. APPROVAL OF ROAD PROJECT. (a) The district
147147 may not undertake a road project authorized by Section 8477.103
148148 unless:
149149 (1) each municipality or county that will operate and
150150 maintain the road has approved the plans and specifications of the
151151 road project, if a municipality or county will operate and maintain
152152 the road; or
153153 (2) the Texas Transportation Commission has approved
154154 the plans and specifications of the road project, if the state will
155155 operate and maintain the road.
156156 (b) Except as provided by Subsection (a), the district is
157157 not required to obtain approval from the Texas Transportation
158158 Commission to design, acquire, construct, finance, issue bonds for,
159159 improve, or convey a road project.
160160 Sec. 8477.105. COMPLIANCE WITH AND ENFORCEABILITY OF
161161 MUNICIPAL CONSENT ORDINANCE OR RESOLUTION. (a) The district shall
162162 comply with all applicable requirements of any ordinance or
163163 resolution that is adopted under Section 54.016 or 54.0165, Water
164164 Code, and that consents to the creation of the district or to the
165165 inclusion of land in the district.
166166 (b) Any agreement between the district and a municipality
167167 related to the municipality's consent to the creation of the
168168 district is valid and enforceable.
169169 (c) On the issuance of bonds by the district, the district
170170 is considered to have waived sovereign immunity to suit by a
171171 municipality for the purpose of adjudicating a claim for breach of
172172 an agreement described by this section.
173173 (d) The district and a municipality may contract on terms
174174 that the board and governing body of the municipality agree will
175175 further regional cooperation between the district and the
176176 municipality.
177177 Sec. 8477.106. NO EMINENT DOMAIN POWER. The district may
178178 not exercise the power of eminent domain.
179179 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
180180 Sec. 8477.151. ELECTIONS REGARDING TAXES OR BONDS.
181181 (a) The district may issue, without an election, bonds and other
182182 obligations secured by:
183183 (1) revenue other than ad valorem taxes; or
184184 (2) contract payments described by Section 8477.153.
185185 (b) The district must hold an election in the manner
186186 provided by Chapters 49 and 54, Water Code, to obtain voter approval
187187 before the district may impose an ad valorem tax or issue bonds
188188 payable from ad valorem taxes.
189189 (c) The district may not issue bonds payable from ad valorem
190190 taxes to finance a road project unless the issuance is approved by a
191191 vote of a two-thirds majority of the district voters voting at an
192192 election held for that purpose.
193193 Sec. 8477.152. OPERATION AND MAINTENANCE TAX. (a) If
194194 authorized at an election held under Section 8477.151, the district
195195 may impose an operation and maintenance tax on taxable property in
196196 the district in accordance with Section 49.107, Water Code.
197197 (b) The board shall determine the tax rate. The rate may not
198198 exceed the rate approved at the election.
199199 (c) If required by an agreement between the district and a
200200 municipality under Section 8477.105, the total ad valorem tax rate
201201 of the district may not be less than the total ad valorem tax rate of
202202 the municipality.
203203 Sec. 8477.153. CONTRACT TAXES. (a) In accordance with
204204 Section 49.108, Water Code, the district may impose a tax other than
205205 an operation and maintenance tax and use the revenue derived from
206206 the tax to make payments under a contract after the provisions of
207207 the contract have been approved by a majority of the district voters
208208 voting at an election held for that purpose.
209209 (b) A contract approved by the district voters may contain a
210210 provision stating that the contract may be modified or amended by
211211 the board without further voter approval.
212212 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
213213 Sec. 8477.201. AUTHORITY TO ISSUE BONDS AND OTHER
214214 OBLIGATIONS. The district may issue bonds or other obligations
215215 payable wholly or partly from ad valorem taxes, impact fees,
216216 revenue, contract payments, grants, or other district money, or any
217217 combination of those sources, to pay for any authorized district
218218 purpose.
219219 Sec. 8477.202. TAXES FOR BONDS. At the time the district
220220 issues bonds payable wholly or partly from ad valorem taxes, the
221221 board shall provide for the annual imposition of a continuing
222222 direct ad valorem tax, without limit as to rate or amount, while all
223223 or part of the bonds are outstanding as required and in the manner
224224 provided by Sections 54.601 and 54.602, Water Code.
225225 Sec. 8477.203. BONDS FOR ROAD PROJECTS. At the time of
226226 issuance, the total principal amount of bonds or other obligations
227227 issued or incurred to finance road projects and payable from ad
228228 valorem taxes may not exceed one-fourth of the assessed value of the
229229 real property in the district.
230230 SUBCHAPTER F. STRATEGIC PARTNERSHIP AGREEMENT; MUNICIPAL
231231 ANNEXATION AND NOTICE
232232 Sec. 8477.301. STRATEGIC PARTNERSHIP; CONTINUATION OF
233233 DISTRICT AFTER ANNEXATION BY MUNICIPALITY. (a) The district may
234234 continue to exist as a limited district after full-purpose
235235 annexation by a municipality if the district and the annexing
236236 municipality state the terms of the limited district's existence in
237237 a strategic partnership agreement under Section 43.0751, Local
238238 Government Code.
239239 (b) The strategic partnership agreement may provide for a
240240 term of any number of years. The limitation in Section
241241 43.0751(g)(2), Local Government Code, on the length of the term
242242 does not apply to a limited district created under this section.
243243 Sec. 8477.302. MUNICIPAL ANNEXATION; NOTICE.
244244 (a) Sections 43.0561 and 43.0562, Local Government Code, do not
245245 apply to the annexation of the district by a municipality that
246246 consents to the creation of the district under Section 8477.004.
247247 (b) Not later than the 30th day after the date a
248248 municipality adopts a resolution or ordinance consenting to the
249249 creation of the district, the municipality shall file, in the real
250250 property records of the county in which the land to be included in
251251 the district is located, a notice to purchasers of real property in
252252 the district that describes:
253253 (1) the municipality's authority and intention to
254254 annex the district; and
255255 (2) the anticipated date of the annexation.
256256 (c) After the notice is filed, a person who proposes to sell
257257 or otherwise convey real property in the district must include the
258258 information contained in the municipality's notice in the Notice to
259259 Purchasers required by Section 49.452, Water Code.
260260 SECTION 2. The Cascades Municipal Utility District No. 1
261261 initially includes all the territory contained in the following
262262 area:
263263 135.796 ACRES, OUT OF THE SANTIAGO DEL VALLE GRANT IN TRAVIS COUNTY,
264264 TEXAS BEING ALL OF THAT 223.68 ACRES OUT OF THE SANTIAGO DEL VALLE
265265 GRANT IN TRAVIS COUNTY, TEXAS AND BEING ALL OF A CALLED 117.188 ACRE
266266 TRACT, ALL OF A CALLED 2.273 ACRE TRACT, ALL OF A CALLED 87.884 ACRE
267267 TRACT, ALL A OF CALLED 8.17 ACRE TRACT ALL DESCRIBED IN CORRECTION
268268 JOINT PARTNERSHIP CONTRIBUTION GENERAL WARRANTY DEED TO ONION
269269 ASSOCIATES, LTD RECORDED IN DOCUMENT NO. 2006236625, ALL OF A
270270 CALLED 1.9965 ACRE TRACT DESCRIBED IN DOC. NO. 2006146663 ALL OF THE

481481 SECTION 3. (a) The legal notice of the intention to
482482 introduce this Act, setting forth the general substance of this
483483 Act, has been published as provided by law, and the notice and a
484484 copy of this Act have been furnished to all persons, agencies,
485485 officials, or entities to which they are required to be furnished
486486 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
487487 Government Code.
488488 (b) The governor, one of the required recipients, has
489489 submitted the notice and Act to the Texas Commission on
490490 Environmental Quality.
491491 (c) The Texas Commission on Environmental Quality has filed
492492 its recommendations relating to this Act with the governor, the
493493 lieutenant governor, and the speaker of the house of
494494 representatives within the required time.
495495 (d) All requirements of the constitution and laws of this
496496 state and the rules and procedures of the legislature with respect
497497 to the notice, introduction, and passage of this Act are fulfilled
498498 and accomplished.
499499 SECTION 4. This Act takes effect immediately if it receives
500500 a vote of two-thirds of all the members elected to each house, as
501501 provided by Section 39, Article III, Texas Constitution. If this
502502 Act does not receive the vote necessary for immediate effect, this
503503 Act takes effect September 1, 2013.
