66 relating to the creation of the Kendall County Municipal Utility

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8484 to read as follows:
1313 CHAPTER 8484. KENDALL COUNTY MUNICIPAL UTILITY DISTRICT NO. 1
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8484.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Commission" means the Texas Commission on
1818 Environmental Quality.
1919 (3) "Director" means a board member.
2020 (4) "District" means the Kendall County Municipal
2121 Utility District No. 1.
2222 Sec. 8484.002. NATURE OF DISTRICT. The district is a
2323 municipal utility district created under Section 59, Article XVI,
2424 Texas Constitution.
2525 Sec. 8484.003. CONFIRMATION AND DIRECTORS' ELECTION
2626 REQUIRED. The temporary directors shall hold an election to
2727 confirm the creation of the district and to elect five permanent
2828 directors as provided by Section 49.102, Water Code.
2929 Sec. 8484.004. CONSENT OF MUNICIPALITY REQUIRED. The
3030 temporary directors may not hold an election under Section 8484.003
3131 until each municipality in whose corporate limits or
3232 extraterritorial jurisdiction the district is located has
3333 consented by ordinance or resolution to the creation of the
3434 district and to the inclusion of land in the district.
3535 Sec. 8484.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3636 (a) The district is created to serve a public purpose and benefit.
3737 (b) The district is created to accomplish the purposes of a
3838 municipal utility district as provided by general law and Section
3939 59, Article XVI, Texas Constitution.
4040 Sec. 8484.006. INITIAL DISTRICT TERRITORY. (a) The
4141 district is initially composed of the territory described by
4242 Section 2 of the Act enacting this chapter.
4343 (b) The boundaries and field notes contained in Section 2 of
4444 the Act enacting this chapter form a closure. A mistake made in the
4545 field notes or in copying the field notes in the legislative process
4646 does not affect the district's:
4747 (1) organization, existence, or validity;
4848 (2) right to issue any type of bond for the purposes
4949 for which the district is created or to pay the principal of and
5050 interest on a bond;
5151 (3) right to impose a tax; or
5252 (4) legality or operation.
5353 SUBCHAPTER B. BOARD OF DIRECTORS
5454 Sec. 8484.051. GOVERNING BODY; TERMS. (a) The district is
5555 governed by a board of five elected directors.
5656 (b) Except as provided by Section 8484.052, directors serve
5757 staggered four-year terms.
5858 Sec. 8484.052. TEMPORARY DIRECTORS. (a) The temporary
5959 board consists of:
6060 (1) Michael Sedlak;
6161 (2) Austin Ruple;
6262 (3) Chris Hoegemeyer;
6363 (4) Scot Wilson; and
6464 (5) Jim Guy Egbert.
6565 (b) Temporary directors serve until the earlier of:
6666 (1) the date permanent directors are elected under
6767 Section 8484.003; or
6868 (2) the fourth anniversary of the effective date of
6969 the Act enacting this chapter.
7070 (c) If permanent directors have not been elected under
7171 Section 8484.003 and the terms of the temporary directors have
7272 expired, successor temporary directors shall be appointed or
7373 reappointed as provided by Subsection (d) to serve terms that
7474 expire on the earlier of:
7575 (1) the date permanent directors are elected under
7676 Section 8484.003; or
7777 (2) the fourth anniversary of the date of the
7878 appointment or reappointment.
7979 (d) If Subsection (c) applies, the owner or owners of a
8080 majority of the assessed value of the real property in the district
8181 may submit a petition to the commission requesting that the
8282 commission appoint as successor temporary directors the five
8383 persons named in the petition. The commission shall appoint as
8484 successor temporary directors the five persons named in the
8585 petition.
8686 SUBCHAPTER C. POWERS AND DUTIES
8787 Sec. 8484.101. GENERAL POWERS AND DUTIES. The district has
8888 the powers and duties necessary to accomplish the purposes for
8989 which the district is created.
9090 Sec. 8484.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9191 DUTIES. The district has the powers and duties provided by the
9292 general law of this state, including Chapters 49 and 54, Water Code,
9393 applicable to municipal utility districts created under Section 59,
9494 Article XVI, Texas Constitution.
9595 Sec. 8484.103. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
9696 OR RESOLUTION. The district shall comply with all applicable
9797 requirements of any ordinance or resolution that is adopted under
9898 Section 54.016 or 54.0165, Water Code, and that consents to the
9999 creation of the district or to the inclusion of land in the
100100 district.
101101 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
102102 Sec. 8484.151. ELECTIONS REGARDING TAXES OR BONDS.
103103 (a) The district may issue, without an election, bonds and other
104104 obligations secured by:
105105 (1) revenue other than ad valorem taxes; or
106106 (2) contract payments described by Section 8484.153.
107107 (b) The district must hold an election in the manner
108108 provided by Chapters 49 and 54, Water Code, to obtain voter approval
109109 before the district may impose an ad valorem tax or issue bonds
110110 payable from ad valorem taxes.
111111 Sec. 8484.152. OPERATION AND MAINTENANCE TAX. (a) If
112112 authorized at an election held under Section 8484.151, the district
113113 may impose an operation and maintenance tax on taxable property in
114114 the district in accordance with Section 49.107, Water Code.
115115 (b) The board shall determine the tax rate. The rate may not
116116 exceed the rate approved at the election.
117117 Sec. 8484.153. CONTRACT TAXES. (a) In accordance with
118118 Section 49.108, Water Code, the district may impose a tax other than
119119 an operation and maintenance tax and use the revenue derived from
120120 the tax to make payments under a contract after the provisions of
121121 the contract have been approved by a majority of the district voters
122122 voting at an election held for that purpose.
123123 (b) A contract approved by the district voters may contain a
124124 provision stating that the contract may be modified or amended by
125125 the board without further voter approval.
126126 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
127127 Sec. 8484.201. AUTHORITY TO ISSUE BONDS AND OTHER
128128 OBLIGATIONS. The district may issue bonds or other obligations
129129 payable wholly or partly from ad valorem taxes, impact fees,
130130 revenue, contract payments, grants, or other district money, or any
131131 combination of those sources, to pay for any authorized district
132132 purpose.
133133 Sec. 8484.202. TAXES FOR BONDS. (a) At the time the
134134 district issues bonds payable wholly or partly from ad valorem
135135 taxes, the board shall provide for the annual imposition of a
136136 continuing direct ad valorem tax, without limit as to rate or
137137 amount, while all or part of the bonds are outstanding as required
138138 and in the manner provided by Sections 54.601 and 54.602, Water
139139 Code.
140140 (b) The board's order to issue bonds and authorize an ad
141141 valorem tax must provide that the imposition of the tax ends and the
142142 district's authority to assess and collect the tax ends on the
143143 retirement of the bonds for which the tax was originally authorized
144144 unless the district voters authorize the extension or continuation
145145 of the ad valorem tax in a subsequent bond election.
146146 SECTION 2. The Kendall County Municipal Utility District
147147 No. 1 initially includes all the territory contained in the
148148 following area:

654654 vote of all the members elected to each house, Subchapter C, Chapter
655655 8484, Special District Local Laws Code, as added by Section 1 of
656656 this Act, is amended by adding Section 8484.104 to read as follows:
657657 Sec. 8484.104. NO EMINENT DOMAIN POWER. The district may
658658 not exercise the power of eminent domain.
659659 (b) This section is not intended to be an expression of a
660660 legislative interpretation of the requirements of Subsection (c),
661661 Section 17, Article I, Texas Constitution.
662662 SECTION 5. This Act takes effect immediately if it receives
663663 a vote of two-thirds of all the members elected to each house, as
664664 provided by Section 39, Article III, Texas Constitution. If this
665665 Act does not receive the vote necessary for immediate effect, this
666666 Act takes effect September 1, 2013.
