7	7	relating to the election of members of the board of directors of the
8	8	Pecan Valley Groundwater Conservation District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 11, Chapter 1343, Acts of the 77th
11	11	Legislature, Regular Session, 2001, is amended to read as follows:
12	12	Sec. 11. ELECTION OF DIRECTORS. [(a)] On the uniform
13	13	election date in November of each even-numbered year, the district
14	14	shall hold an election in the district to elect [first Saturday in
15	15	May of the second year after the year in which the district is
16	16	authorized to be created at a confirmation election, an election
17	17	shall be held in the district for the election of directors for
18	18	Precincts One and Three.
19	19	[(b) On the first Saturday in May of the fourth year after
20	20	the year in which the district is authorized to be created at a
21	21	confirmation election, an election shall be held in the district
22	22	for the election of directors for Precincts Two and Four and the
23	23	at-large director.
24	24	[(c) On the first Saturday in May of each subsequent second
25	25	year following the election under Subsection (b) of this section,]
26	26	the appropriate number of directors to the district's board of
27	27	directors [shall be elected].
28	28	SECTION 2. Subsection (e), Section 8, Chapter 1343, Acts of
29	29	the 77th Legislature, Regular Session, 2001, is repealed.
30	30	SECTION 3. A director on the board of the Pecan Valley
31	31	Groundwater Conservation District whose term is scheduled to expire
32	32	in May 2013 shall serve until the director's successor has
33	33	qualified following the directors' election held on the uniform
34	34	election date in November 2013. A director whose term is scheduled
35	35	to expire in May 2015 shall serve until the director's successor has
36	36	qualified following the directors' election held on the uniform
37	37	election date in November 2014. A director whose term is scheduled
38	38	to expire in May 2017 shall serve until the director's successor has
39	39	qualified following the directors' election held on the uniform
40	40	election date in November 2016.
41	41	SECTION 4. (a) All governmental acts and proceedings of
42	42	the Pecan Valley Groundwater Conservation District relating to the
43	43	election of members of the board of directors of the district that
44	44	were taken before the effective date of this Act are validated,
45	45	ratified, and confirmed in all respects as if they had been taken as
46	46	authorized by law.
47	47	(b) This section does not apply to any matter that on the
48	48	effective date of this Act:
49	49	(1) is involved in litigation if the litigation
50	50	ultimately results in the matter being held invalid by a final court
51	51	judgment; or
52	52	(2) has been held invalid by a final court judgment.
53	53	SECTION 5. (a) The legal notice of the intention to
54	54	introduce this Act, setting forth the general substance of this
55	55	Act, has been published as provided by law, and the notice and a
56	56	copy of this Act have been furnished to all persons, agencies,
57	57	officials, or entities to which they are required to be furnished
58	58	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
59	59	Government Code.
60	60	(b) The governor, one of the required recipients, has
61	61	submitted the notice and Act to the Texas Commission on
62	62	Environmental Quality.
63	63	(c) The Texas Commission on Environmental Quality has filed
64	64	its recommendations relating to this Act with the governor, the
65	65	lieutenant governor, and the speaker of the house of
66	66	representatives within the required time.
67	67	(d) All requirements of the constitution and laws of this
68	68	state and the rules and procedures of the legislature with respect
69	69	to the notice, introduction, and passage of this Act are fulfilled
70	70	and accomplished.
71	71	SECTION 6. This Act takes effect immediately if it receives
72	72	a vote of two-thirds of all the members elected to each house, as
73	73	provided by Section 39, Article III, Texas Constitution. If this
74	74	Act does not receive the vote necessary for immediate effect, this
75	75	Act takes effect September 1, 2013.
