77 relating to the election of members of the board of directors of the
88 Pecan Valley Groundwater Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11, Chapter 1343, Acts of the 77th
1111 Legislature, Regular Session, 2001, is amended to read as follows:
1212 Sec. 11. ELECTION OF DIRECTORS. [(a)] On the uniform
1313 election date in November of each even-numbered year, the district
1414 shall hold an election in the district to elect [first Saturday in
1515 May of the second year after the year in which the district is
1616 authorized to be created at a confirmation election, an election
1717 shall be held in the district for the election of directors for
1818 Precincts One and Three.
1919 [(b) On the first Saturday in May of the fourth year after
2020 the year in which the district is authorized to be created at a
2121 confirmation election, an election shall be held in the district
2222 for the election of directors for Precincts Two and Four and the
2323 at-large director.
2424 [(c) On the first Saturday in May of each subsequent second
2525 year following the election under Subsection (b) of this section,]
2626 the appropriate number of directors to the district's board of
2727 directors [shall be elected].
2828 SECTION 2. Subsection (e), Section 8, Chapter 1343, Acts of
2929 the 77th Legislature, Regular Session, 2001, is repealed.
3030 SECTION 3. A director on the board of the Pecan Valley
3131 Groundwater Conservation District whose term is scheduled to expire
3232 in May 2013 shall serve until the director's successor has
3333 qualified following the directors' election held on the uniform
3434 election date in November 2013. A director whose term is scheduled
3535 to expire in May 2015 shall serve until the director's successor has
3636 qualified following the directors' election held on the uniform
3737 election date in November 2014. A director whose term is scheduled
3838 to expire in May 2017 shall serve until the director's successor has
3939 qualified following the directors' election held on the uniform
4040 election date in November 2016.
4141 SECTION 4. (a) All governmental acts and proceedings of
4242 the Pecan Valley Groundwater Conservation District relating to the
4343 election of members of the board of directors of the district that
4444 were taken before the effective date of this Act are validated,
4545 ratified, and confirmed in all respects as if they had been taken as
4646 authorized by law.
4747 (b) This section does not apply to any matter that on the
4848 effective date of this Act:
4949 (1) is involved in litigation if the litigation
5050 ultimately results in the matter being held invalid by a final court
5151 judgment; or
5252 (2) has been held invalid by a final court judgment.
5353 SECTION 5. (a) The legal notice of the intention to
5454 introduce this Act, setting forth the general substance of this
5555 Act, has been published as provided by law, and the notice and a
5656 copy of this Act have been furnished to all persons, agencies,
5757 officials, or entities to which they are required to be furnished
5858 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5959 Government Code.
6060 (b) The governor, one of the required recipients, has
6161 submitted the notice and Act to the Texas Commission on
6262 Environmental Quality.
6363 (c) The Texas Commission on Environmental Quality has filed
6464 its recommendations relating to this Act with the governor, the
6565 lieutenant governor, and the speaker of the house of
6666 representatives within the required time.
6767 (d) All requirements of the constitution and laws of this
6868 state and the rules and procedures of the legislature with respect
6969 to the notice, introduction, and passage of this Act are fulfilled
7070 and accomplished.
7171 SECTION 6. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2013.
