99 relating to the authority of the Dallas County Hospital District or
1010 a nonprofit corporation formed by the district regarding certain
1111 technology or intellectual property owned by or licensed to the
1212 district or corporation.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter C, Chapter 281, Health and Safety
1515 Code, is amended by adding Section 281.0518 to read as follows:
1616 Sec. 281.0518. DALLAS COUNTY HOSPITAL DISTRICT; AUTHORITY
1717 TO SELL OR LICENSE INTELLECTUAL PROPERTY. (a) The Dallas County
1818 Hospital District or a nonprofit corporation formed by the district
1919 may:
2020 (1) sell or license technology or intellectual
2121 property that is owned by or licensed to the district or a nonprofit
2222 corporation formed by the district;
2323 (2) enter into a contract to provide services related
2424 to technology or intellectual property sold or licensed under
2525 Subdivision (1);
2626 (3) contract, collaborate, or enter into a joint
2727 venture or other agreement with a public or private entity to engage
2828 in an activity authorized under Subdivision (1) or (2); or
2929 (4) take any other action necessary to protect or
3030 benefit from the exclusivity of technology and intellectual
3131 property owned by or licensed to the district or a nonprofit
3232 corporation formed by the district, including applying for,
3333 acquiring, registering, securing, holding, protecting, and
3434 renewing under applicable provisions of state, federal, or
3535 international law:
3636 (A) a patent;
3737 (B) a copyright;
3838 (C) a trademark, service mark, collective mark,
3939 or certification mark; or
4040 (D) any other form of protection of intellectual
4141 property provided by law.
4242 (b) Information prepared or compiled by or for the Dallas
4343 County Hospital District or a nonprofit corporation formed by the
4444 district relating to the development of technology or intellectual
4545 property to which this section applies is exempt from public
4646 disclosure under Chapter 552, Government Code.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2013.
