 A BILL TO BE ENTITLED
 AN ACT
 relating to the maintenance by the Legislative Budget Board of a
 searchable database containing certain budget information.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 322, Government Code, is amended by
 adding Section 322.023 to read as follows:
 Sec. 322.023.  BUDGET DATABASE. (a)  Subject to Subsection
 (e), the Legislative Budget Board shall post on an Internet site
 maintained by the board a database containing the information that
 the board uses to prepare the general appropriations bill as filed
 and as subsequently amended, substituted, engrossed, or enrolled in
 either house of the legislature.
 (b)  The board shall post information to the database as soon
 as practicable after receipt of the information.
 (c)  The information contained in the database must be raw
 data in open standard format that allows the public to search,
 extract, organize, and analyze the information.
 (d)  The board may not publish in the database information
 that is not subject to required disclosure under Chapter 552 or that
 is confidential.
 (e)  The board may post and update information under
 Subsection (a) only if the board:
 (1)  determines that, using existing resources, the
 board can post and update the information on the Internet site at no
 additional cost to the state;
 (2)  enters into a contract advantageous to the state
 under which the contractor posts and updates the information on the
 Internet site at no additional cost to the state; or
 (3)  receives a gift or grant specifically for the
 purpose of posting and updating the information on the Internet
 site.
 (f)  The board may accept a gift or grant for the purpose of
 posting and updating the information described by Subsection (a) on
 an Internet site.
 SECTION 2.  Section 322.023, Government Code, as added by
 this Act, applies only to information received on or after October
 1, 2013.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2013.
