There are only three other Texas commissions that still have term limits. By imposing term limits on commissioners, the state runs the risk of losing institutional knowledge that is gained over time. S.B. 221 eliminates term limits for Texas Funeral Service commissioners. As proposed, S.B. 221 amends current law relating to the composition and employees of the Texas Funeral Service Commission. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 651.054(a), Occupations Code, to delete existing text prohibiting a member of the Texas Funeral Service Commission (TFSC) from being appointed for more than one full term, except that a member appointed to fill an unexpired term with less than three years remaining in the unexpired term is authorized to be reappointed to TFSC for one full-term. SECTION 2. Repealer: Section 651.060(b) (relating to prohibiting TFSC from employing legal counsel except as provided by Section 402.0212 (Provision of Legal Services--Outside Counsel), Government Code), Occupations Code. SECTION 3. Effective date: upon passage or September 1, 2013.
