77 relating to the venue for prosecution of certain computer crimes.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (b), Article 13.25, Code of Criminal
1010 Procedure, is amended to read as follows:
1111 (b) An offense under Chapter 33, Penal Code, may be
1212 prosecuted in:
1313 (1) the county of the principal place of business of
1414 the owner or lessee of a computer, computer network, or computer
1515 system involved in the offense;
1616 (2) any county in which a defendant had control or
1717 possession of:
1818 (A) any proceeds of the offense; or
1919 (B) any books, records, documents, property,
2020 negotiable instruments, computer programs, or other material used
2121 in furtherance of the offense; [or]
2222 (3) any county from which, to which, or through which
2323 access to a computer, computer network, computer program, or
2424 computer system was made in violation of Chapter 33, whether by
2525 wires, electromagnetic waves, microwaves, or any other means of
2626 communication; or
2727 (4) any county in which an individual who is a victim
2828 of the offense resides.
2929 SECTION 2. This Act applies only to a criminal case in which
3030 the indictment, information, or complaint is presented to the court
3131 on or after the effective date of this Act. A criminal case in which
3232 the indictment, information, or complaint was presented to the
3333 court before the effective date of this Act is governed by the law
3434 in effect when the indictment, information, or complaint was
3535 presented, and the former law is continued in effect for that
3636 purpose.
3737 SECTION 3. This Act takes effect September 1, 2013.
