66 AN ACT
77 relating to granting limited state law enforcement authority to
88 police officers with the Office of Security and Law Enforcement of
99 the United States Department of Veterans Affairs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (a), Article 2.122, Code of Criminal
1212 Procedure, as amended by Chapters 1223 (S.B. 530) and 1319 (S.B.
1313 150), Acts of the 82nd Legislature, Regular Session, 2011, is
1414 reenacted and amended to read as follows:
1515 (a) The following named criminal investigators of the
1616 United States shall not be deemed peace officers, but shall have the
1717 powers of arrest, search, and seizure under the laws of this state
1818 as to felony offenses only:
1919 (1) Special Agents of the Federal Bureau of
2020 Investigation;
2121 (2) Special Agents of the Secret Service;
2222 (3) Special Agents of the United States Immigration
2323 and Customs Enforcement;
2424 (4) Special Agents of the Bureau of Alcohol, Tobacco,
2525 Firearms and Explosives;
2626 (5) Special Agents of the United States Drug
2727 Enforcement Administration;
2828 (6) Inspectors of the United States Postal Inspection
2929 Service;
3030 (7) Special Agents of the Criminal Investigation
3131 Division of the Internal Revenue Service;
3232 (8) Civilian Special Agents of the United States Naval
3333 Criminal Investigative Service;
3434 (9) Marshals and Deputy Marshals of the United States
3535 Marshals Service;
3636 (10) Special Agents of the United States Department of
3737 State, Bureau of Diplomatic Security;
3838 (11) Special Agents of the Treasury Inspector General
3939 for Tax Administration; [and]
4040 (12) Special Agents of the Office of Inspector General
4141 of the United States Social Security Administration;
4242 (13) [(12)] Special Agents of the Office of Inspector
4343 General of the United States Department of Veterans Affairs; and
4444 (14) a police officer with the Office of Security and
4545 Law Enforcement of the United States Department of Veterans
4646 Affairs.
4747 SECTION 2. To the extent of any conflict, this Act prevails
4848 over another Act of the 83rd Legislature, Regular Session, 2013,
4949 relating to nonsubstantive additions to and corrections in enacted
5050 codes.
5151 SECTION 3. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2013.
