10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subsection (a), Article 2.122, Code of Criminal |
---|
12 | 12 | | Procedure, as amended by Chapters 1223 (S.B. 530) and 1319 (S.B. |
---|
13 | 13 | | 150), Acts of the 82nd Legislature, Regular Session, 2011, is |
---|
14 | 14 | | reenacted and amended to read as follows: |
---|
15 | 15 | | (a) The following named criminal investigators of the |
---|
16 | 16 | | United States shall not be deemed peace officers, but shall have the |
---|
17 | 17 | | powers of arrest, search, and seizure under the laws of this state |
---|
18 | 18 | | as to felony offenses only: |
---|
19 | 19 | | (1) Special Agents of the Federal Bureau of |
---|
20 | 20 | | Investigation; |
---|
21 | 21 | | (2) Special Agents of the Secret Service; |
---|
22 | 22 | | (3) Special Agents of the United States Immigration |
---|
23 | 23 | | and Customs Enforcement; |
---|
24 | 24 | | (4) Special Agents of the Bureau of Alcohol, Tobacco, |
---|
25 | 25 | | Firearms and Explosives; |
---|
26 | 26 | | (5) Special Agents of the United States Drug |
---|
27 | 27 | | Enforcement Administration; |
---|
28 | 28 | | (6) Inspectors of the United States Postal Inspection |
---|
29 | 29 | | Service; |
---|
30 | 30 | | (7) Special Agents of the Criminal Investigation |
---|
31 | 31 | | Division of the Internal Revenue Service; |

47 | 47 | | SECTION 2. To the extent of any conflict, this Act prevails |
---|
48 | 48 | | over another Act of the 83rd Legislature, Regular Session, 2013, |
---|
49 | 49 | | relating to nonsubstantive additions to and corrections in enacted |
---|
50 | 50 | | codes. |
---|
51 | 51 | | SECTION 3. This Act takes effect immediately if it receives |
---|
52 | 52 | | a vote of two-thirds of all the members elected to each house, as |
---|
53 | 53 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
54 | 54 | | Act does not receive the vote necessary for immediate effect, this |
---|
55 | 55 | | Act takes effect September 1, 2013. |
