77 relating to continuing education for pharmacists regarding drug
88 abuse and opioid drugs and an interim study regarding opioid abuse.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 559, Occupations Code, is
1111 amended by adding Section 559.0525 to read as follows:
1212 Sec. 559.0525. CONTINUING EDUCATION RELATING TO OPIOID
1313 DRUGS. (a) The board shall develop a continuing education program
1414 regarding opioid drug abuse and the delivery, dispensing, and
1515 provision of tamper-resistant opioid drugs after considering input
1616 from interested persons.
1717 (b) The board by rule may require a license holder to
1818 satisfy a number of the continuing education hours required by
1919 Section 559.053 through attendance of a program developed under
2020 this section.
2121 SECTION 2. (a) The standing committee of the senate that
2222 has primary jurisdiction over health and human services shall
2323 conduct an interim study regarding opioid abuse and the provision
2424 of tamper-resistant opioids.
2525 (b) The committee may establish appropriate criteria for
2626 the study to accomplish the study's purpose. The study must include
2727 an examination of:
2828 (1) matters relating to prescription opioid abuse; and
2929 (2) the use and effectiveness of tamper-resistant
3030 opioids.
3131 (c) Not later than December 1, 2014, the committee shall
3232 submit a report of the committee's findings and recommendations to
3333 the lieutenant governor and the speaker of the house of
3434 representatives for consideration by the 84th Legislature. The
3535 committee shall include in its report the results of the study
3636 conducted under this section and the committee's recommendations
3737 for specific statutory changes, if any.
3838 (d) This section expires September 1, 2015.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2013.
