77 relating to the period for confirmation and the terms of the
88 temporary directors of the Montgomery County Municipal Utility
99 District No. 117.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 8268.021, Special District Local Laws
1212 Code, is amended by amending Subsection (b) and adding Subsections
1313 (c) and (d) to read as follows:
1414 (b) Temporary directors serve until the earlier of:
1515 (1) the date initial directors are elected under
1616 Section 8268.023; or
1717 (2) September 1, 2013 [the date this subchapter
1818 expires under Section 8268.025].
1919 (c) If initial directors have not been elected under Section
2020 8268.023 and the terms of the temporary directors have expired,
2121 successor temporary directors shall be appointed or reappointed as
2222 provided by Subsection (d) to serve terms that expire on the earlier
2323 of:
2424 (1) the date initial directors are elected under
2525 Section 8268.023; or
2626 (2) the fourth anniversary of the date of the
2727 appointment or reappointment.
2828 (d) If Subsection (c) applies, the owner or owners of a
2929 majority of the assessed value of the real property in the district
3030 may submit a petition to the Texas Commission on Environmental
3131 Quality requesting that the commission appoint as successor
3232 temporary directors the five persons named in the petition. The
3333 commission shall appoint as successor temporary directors the five
3434 persons named in the petition.
3535 SECTION 2. Sections 8268.003 and 8268.025, Special District
3636 Local Laws Code, are repealed.
3737 SECTION 3. (a) The legal notice of the intention to
3838 introduce this Act, setting forth the general substance of this
3939 Act, has been published as provided by law, and the notice and a
4040 copy of this Act have been furnished to all persons, agencies,
4141 officials, or entities to which they are required to be furnished
4242 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4343 Government Code.
4444 (b) The governor, one of the required recipients, has
4545 submitted the notice and Act to the Texas Commission on
4646 Environmental Quality.
4747 (c) The Texas Commission on Environmental Quality has filed
4848 its recommendations relating to this Act with the governor, the
4949 lieutenant governor, and the speaker of the house of
5050 representatives within the required time.
5151 (d) All requirements of the constitution and laws of this
5252 state and the rules and procedures of the legislature with respect
5353 to the notice, introduction, and passage of this Act are fulfilled
5454 and accomplished.
5555 SECTION 4. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2013.
