| 7 | 7 | | relating to the period for confirmation and the terms of the |

| 8 | 8 | | temporary directors of the Montgomery County Municipal Utility |
|---|
| 9 | 9 | | District No. 117. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 8268.021, Special District Local Laws |
|---|
| 12 | 12 | | Code, is amended by amending Subsection (b) and adding Subsections |
|---|
| 13 | 13 | | (c) and (d) to read as follows: |
|---|
| 14 | 14 | | (b) Temporary directors serve until the earlier of: |
|---|
| 15 | 15 | | (1) the date initial directors are elected under |
|---|
| 16 | 16 | | Section 8268.023; or |
|---|
| 17 | 17 | | (2) September 1, 2013 [the date this subchapter |
|---|
| 18 | 18 | | expires under Section 8268.025]. |
|---|
| 19 | 19 | | (c) If initial directors have not been elected under Section |
|---|
| 20 | 20 | | 8268.023 and the terms of the temporary directors have expired, |
|---|
| 21 | 21 | | successor temporary directors shall be appointed or reappointed as |
|---|
| 22 | 22 | | provided by Subsection (d) to serve terms that expire on the earlier |
|---|
| 23 | 23 | | of: |
|---|
| 24 | 24 | | (1) the date initial directors are elected under |
|---|
| 25 | 25 | | Section 8268.023; or |
|---|
| 26 | 26 | | (2) the fourth anniversary of the date of the |
|---|
| 27 | 27 | | appointment or reappointment. |
|---|
| 28 | 28 | | (d) If Subsection (c) applies, the owner or owners of a |
|---|
| 29 | 29 | | majority of the assessed value of the real property in the district |
|---|
| 30 | 30 | | may submit a petition to the Texas Commission on Environmental |
|---|
| 31 | 31 | | Quality requesting that the commission appoint as successor |
|---|
| 32 | 32 | | temporary directors the five persons named in the petition. The |
|---|
| 33 | 33 | | commission shall appoint as successor temporary directors the five |
|---|
| 34 | 34 | | persons named in the petition. |
|---|
| 35 | 35 | | SECTION 2. Sections 8268.003 and 8268.025, Special District |
|---|
| 36 | 36 | | Local Laws Code, are repealed. |
|---|
| 37 | 37 | | SECTION 3. (a) The legal notice of the intention to |
|---|
| 38 | 38 | | introduce this Act, setting forth the general substance of this |
|---|
| 39 | 39 | | Act, has been published as provided by law, and the notice and a |
|---|
| 40 | 40 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 41 | 41 | | officials, or entities to which they are required to be furnished |
|---|
| 42 | 42 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 43 | 43 | | Government Code. |
|---|
| 44 | 44 | | (b) The governor, one of the required recipients, has |
|---|
| 45 | 45 | | submitted the notice and Act to the Texas Commission on |
|---|
| 46 | 46 | | Environmental Quality. |
|---|
| 47 | 47 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 48 | 48 | | its recommendations relating to this Act with the governor, the |
|---|
| 49 | 49 | | lieutenant governor, and the speaker of the house of |
|---|
| 50 | 50 | | representatives within the required time. |
|---|
| 51 | 51 | | (d) All requirements of the constitution and laws of this |
|---|
| 52 | 52 | | state and the rules and procedures of the legislature with respect |
|---|
| 53 | 53 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 54 | 54 | | and accomplished. |
|---|
| 55 | 55 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 56 | 56 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 57 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 58 | 58 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 59 | 59 | | Act takes effect September 1, 2013. |
