99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2, Article 49.25, Code of Criminal
1111 Procedure, is amended to read as follows:
1212 Sec. 2. APPOINTMENTS AND QUALIFICATIONS. (a) The
1313 commissioners court shall appoint the medical examiner, who serves
1414 [shall serve] at the pleasure of the commissioners court. A [No]
1515 person [shall be] appointed as the medical examiner must be:
1616 (1) [unless he is] a physician licensed by the Texas
1717 Medical [State] Board; or
1818 (2) a person who:
1919 (A) is licensed and in good standing as a
2020 physician in another state;
2121 (B) has applied to the Texas Medical Board for a
2222 license to practice medicine in this state; and
2323 (C) has been granted a provisional license under
2424 Section 155.101, Occupations Code [of Medical Examiners].
2525 (b) To the greatest extent possible, the medical examiner
2626 shall be appointed from persons having training and experience in
2727 pathology, toxicology, histology and other medico-legal sciences.
2828 (c) The medical examiner shall devote the [so much of his]
2929 time and energy [as is] necessary to perform [in the performance of]
3030 the duties conferred by this Article.
3131 SECTION 2. This Act takes effect September 1, 2013.
